To prepare staff for the inspection, a pre-inspection briefing was held on December 10, 2017. The inspection assessed compliance with adult regulations in Titles 15 and 24, Minimum Standards for Local Detention Facilities, California Code of Regulations (CCR). It consisted of a “walk-through” of each physical plant, review of policies and procedures governing operations, and staff/inmate interviews. Additionally, we met with health care, inmate program and food services administrators and managers. As in past inspections, we interviewed custody administrators, managers, supervisory and line staff associated with the facilities. We also interviewed inmates to ensure they have the opportunity to receive programs afforded to them. We want to express our appreciation to Captain Eric Taylor, Lieutenants Patrick Corso and James Jensen, Sergeants Arthur Candelaria and Victoria Solis, Deputies Allegra Aponte, Brett Bernal and Robert Mickanen for their support and availability throughout the inspections. BSCC Inspection: Title 15, CCR; Policy, Procedures & Practice System Wide This report addresses compliance issues with Title 15 and 24, California Code of Regulations (CCR) for the Santa Clara County Sheriff’s Department. This report will address the detention facilities in one section of the report and the Court Services Division in a separate heading. I will be addressing my observations and documentations for each facility which led to non-compliance for a specific Title 15 and 24 CCR as required by 6031.1. PC. Title 15, CCR; Policy and Procedures: All three facilities operate as a system; therefore, policies and procedures reviewed are applicable to each. Staff members are constantly in the process of reviewing and revising policies. We informed your staff that there is a recently updated version of Title 15 Minimum Standards and that the facility should go through the new standards to ensure that the facility will remain in compliance with their policy and procedures manual. Please review the enclosed policy and procedures checklist. As mentioned above, a desk audit of the Corrections Division’s Policy and Procedures Manual was conducted prior to the on-site inspection. On-site BSCC continued its inspection by evaluating procedures at the facility and comparing them against policy. Those evaluations include a review of documentation related to jail operations including security logs, shift schedules, local inspection results, classification/housing assignments, incident reports, disciplinary actions, grievance actions and other records which give insight to the facility’s operations. When applicable, special attention was given to those low-incidence but high-liability practices involving inebriated inmates, high-risk inmates and use of restraints and safety cells placement. BSCC sought to ensure that practices matched regulations and that written documents reflected actual events. BSCC interviewed staff to ensure that documented procedures were being performed according to policy. All documents reviewed were completed and well organized. We found no issues of non-compliance. Staffing: One key determination to be made during the inspection process is the adequacy of staffing. Title 15 Section 1027 requires each facility to maintain adequate on-duty staff to ensure the implementation of all programs and activities as required by regulation. Supervision of arrestees is the responsibility of correctional officers, supervised generally by a facility Manager. BSCC reviewed security check logs, incident reports and arrestee files to ensure that all required tasks were completed in a timely and safe manner. We found no issues of non-compliance. Medical/Mental Health Services: Medical care is provided by the Santa Clara Valley Medical Center to the inmates from the time of booking through release. All inmates are medically screened upon arrival and evaluated for medical and mental health conditions which could require continued care and treatment. Health professionals are on duty 24/7 5120 + SCSD DOC LTR; 07/18/2018 Laurie Smith, Sheriff 4 | P age and provide a full range of services including daily physician sick call, medication administration, treatments, dialysis, radiology services, dental care and psychiatric care. Physical Plant Inspections Santa Clara County Main Jail: Sergeant Arthur Candelaria and Deputies Allegra Aponte and Brett Bernal accompanied us during our site inspection. The Main Jail was evaluated as a Type II Facility under the 1963, 1980, and 1988 Standards that were in effect at the time of the original construction and when various areas were remodeled or added to the facility. With the completion of the current renovation project on living units 4A and 5A the Rated Capacity (RC) was decreased from 1356 to 1350. The facility has eight floors and utilizes “direct supervision” inmate management. Each living unit is supervised by one, two or three custody staff depending on the classification of the unit. The infirmary, which is located on the second floor, is staffed by nurses and doctors employed through the Valley Medical Center as well as custody staff. Additionally the jail houses acute mental health inmates, on the eighth floor, which is staffed with specially trained officers and Valley Medical Center staff. The Main Jail South facility’s recreation/exercise area (Sundeck) was remodeled (modified) by constructing an enclosed recreation yard inside the original recreation yard. These enclosures allow housing units flexibility to have more maximum-security inmates participate in recreation at the same time, in order to meet and satisfy Title 15, Section 1065, Exercise and Recreation. The recreation enclosure space is adequate to allow inmates to run, perform large muscle exercises and throw/bounce a ball. The “Living Area Space Evaluation” has been updated on numerous occasions to reflect changes throughout the years. The facility has a BSCC rated capacity of 1356 with 1549 actual beds. There were 768 males and 5 females in custody on the day of the inspection. The facility as a whole was clean and appeared well maintained. The old South Jail was half empty in anticipation of being torn down and replaced. The new construction will begin later this year. The physical plant complies with applicable standards with the following exceptions: 1231.2.2, Temporary Holding Cells: Each holding cell has a RC, which is based on the size of the cells and the bench space. The maximum number of inmates in any holding cell cannot go over 16. On the day of the inspection there were 26 inmates in the holding cell T4. Elmwood Complex – Men’s Facility: Sergeant Solis and Deputy Mickanen accompanied us during our site inspection. This facility was evaluated as a Type II Facility under the 1963, 1980, and 1991 standards that were in effect at the time of original construction, and when various areas were remodeled or added to the facility. As with the main jail, the “Living Area Space Evaluation” continues to be a work in progress. The facility continues to remodel, renovate and close several living areas. Barracks 11, 12, 15-21 were closed. The Rated Capacity was increased from 2176 with an overall 2989 beds available. On the date of the inspection, there were 2048 inmates in custody. This facility was evaluated as a Type II Facility under the 1963, 1980, and 1986 standards that were in effect at the time of the original construction and when various areas were remodeled or added to the facility. The rated capacity is 634; however, there are 720 beds available. The total count of inmates the day of the inspection was 411. The physical plant complies with applicable standards. Court Security Services Division Inspections Prior to the on-site portion of the inspection we reviewed relevant policy and procedures and supporting documentation where necessary. The Court Holding facilities have a consolidated manual applicable to all facilities. Post orders, specifically designed for the various facilities, provide guidance to staff at those facilities. There were no items of noncompliance with Title 15. Please refer to the Procedures Checklist for further comments/discussion. Lieutenant James Jensen escorted BSCC to each facility as we conducted the physical plant evaluation. During the on-site portion of the inspections, we compared the manuals against the practices of staff at each facility. Staff we interviewed were well prepared and engaged in the inspection process. We also reviewed samples of safety checks logs, inmate records, classification records, and incident reports, among other documentation. All forms were complete and conformed with the department’s policies and procedures including operational requirements as set forth in Title 15. Hall of Justice: Completed in 1991, the Hall of Justice Court Holding is evaluated using 1980 physical plant standards in place at the time of original construction. No issues of non-compliance with Title 24 standards were identified. Juveniles who are attending adult court will be held in a holding cell in the basement detention area. The Sheriff’s deputies ensure separation between adults and juveniles. We reiterated the federal and state laws and regulations regarding separation of adults and minors. Family Justice Center: The new Family Justice Center Courthouse opened to the public on August 15, 2016. The facility is evaluated using 2010 physical plant standards. At the time of the inspection there were 33 inmates in custody. No issues of non-compliance with Title 24 standards were identified. Juveniles who are attending adult court will be held in the juvenile holding area, separate from adult prisoners. The Sheriff’s deputies ensure separation between adults and juveniles. South County Courthouse: The facility is evaluated using 2001 physical plant standards. At the time of the inspection there were 23 inmates in custody.
