Lopey, Sheriff Siskiyou County Sheriff’s Office 305 Butte Street Yreka, CA 96097 2018-2020 BIENNIAL INSPECTION OF SISKIYOU COUNTY SHERIFF’s OFFICE, SISKIYOU COUNTY JAIL, PENAL CODE 6031 Dear Sheriff Lopey: On May 20, 2020, staff of the Board of State and Community Corrections (BSCC) conducted the 2018-2020 biennial inspection of the Siskiyou County Jail. Pursuant to Penal Code Section 6031, this inspection was performed to determine compliance with the Minimum Standards for Local Detention Facilities as outlined in Titles 15 and 24, California Code of Regulations (CCR). In addition, BSCC staff conducts compliance monitoring pursuant to the federal Juvenile Justice and Delinquency Prevention Act (JJDPA) for the separation requirements of juveniles from incarcerated adults. Due to the coronavirus pandemic and the issuance of a statewide shelter-in-place order, the BSCC was unable to complete on-site inspections from mid-March through June 30, 2020, the end of the 2018-2020 biennial inspection cycle. BSCC staff conducted virtual inspections via desk audit of all facilities originally scheduled for inspection during this time. Desk audits are comprised of a comprehensive review of all applicable policies and procedures and documentation. The complete BSCC inspection report is enclosed and consists of this transmittal letter, the Title 15 Procedures Checklist outlining applicable minimum standards, a Physical Plant Evaluation Outlining Title 24 requirements for design and, a Living Area Space Evaluation summarizing the physical plant configuration and showing the capacity of the facility. Refer to the Title 15 Checklist for indication of compliance status and evidence used to determine compliance. LOCAL INSPECTIONS In addition to the biennial inspection by the BSCC, inspections are also required annually by the County Health Officer and biennially by the State Fire Marshal or an authorized representative (Health and Safety Code Sections 101045 and 13146.1). Please consider our report in conjunction with the reports from the County Health Officer and the respective fire authorities for a comprehensive perspective of your facilities. Local inspection reports are forwarded to your office under a separate cover. The local health inspector did not report finding any non-compliance items. BSCC INSPECTION The inspection consisted of a review of the Siskiyou County Sheriff’s Office Custody Services Manual and sections of the Siskiyou County Sheriff’s Office Policy Manual that apply to Jail Operations. In addition, relevant documentation, phone interview with the Jail Commander and Sergeant, and a discussion of any changes to the physical plant of facility. Title 15, CCR Inspection Our evaluation consisted of reviewing only those policies and procedures related specifically to the applicable regulations included in Title 15, CCR.1 We identified the following item of noncompliance: Title 15, §1027.5, Safety Checks: Safety checks shall be conducted at least hourly through direct visual observation of all inmates. There shall be no more than a 60-minute lapse between safety checks. BSCC Staff reviewed safety checks conducted in February, March, April, and May 2020. Over 20% of those checks were beyond 60 minutes. As part of the inspection process, BSCC staff and the Jail Manager discussed corrective action to ensure future compliance with this regulation. Captain Bradford has since informed BSCC that the technical assistance was acted upon and the agency has resolved the on-going issue of non-compliance with the timing of safety checks. BSCC staff will verify compliance at the next scheduled site visit. Please refer to the Procedures Checklist for detailed information. 1 BSCC does not review all policies and procedures. We do not “approve” policies and procedures, nor do we review them for constitutional or legal issues. We recommend agencies seek review through their legal advisor, risk manager and other persons deemed appropriate. 5461 Siskiyou II LTR 18-20 Sheriff Lopey Siskiyou County Sheriff’s Office Page 3 Title 24, CCR Physical Plant Through interviewing the Jail Commander and Sergeant, BSCC Staff was able to determine that there were no changes made to the physical plant and the rated capacity remains at 104. The Jail was originally constructed under the 1986 Title 24 Regulations with some renovations completed under the 1994 Title 24 Regulations. On the day of the interview, there were 65 inmates, 57 males and 8 females, being held in the facility. There were no issues of non-compliance. Corrective Action Plan BSCC staff will verify corrective actions related to safety checks at the next scheduled inspection. Juvenile Justice and Delinquency Prevention Act Compliance In accordance with JJDPA. BSCC monitors jail facilities for compliance with one of four core requirements of the Act, Separation of Juveniles from Incarcerated Adults. Minors are not housed or detained at this facility; therefore, no violations of the JJDPA were identified. This concludes our inspection report for the 2018-2020 biennial inspection cycle of the Siskiyou County Jail Facility.
