March 06, 2020 Mike Hamasaki, Chief Probation Officer Stanislaus County Probation Department 2215 Blue Gum Avenue Modesto, CA 95358 RE: STANISLAUS COUNTY 2018/2020 BIENNIAL INSPECTION PURSUANT TO WELFARE AND INSTITUTIONS CODE SECTION 209 AND 885 Dear Chief Hamasaki: The 2018/2020 biennial inspection of the Stanislaus County Probation Department’s Juvenile Hall and the Juvenile Commitment Facility has been completed. A pre- inspection briefing was held on April 17, 2019 and the facilities were inspected on December 17 through 20, 2019. The complete Board of State and Community Corrections (BSCC) inspection report is enclosed and consists of the following: this transmittal letter; a Title 15 Procedures checklist, outlining applicable minimum standards for juvenile detention facilities; a Physical Plant Evaluation, outlining applicable Title 24 minimum standards; and the Living Area Space Evaluation (LASE), summarizing the physical plant configuration and outlining the rated capacity of the Stanislaus County Juvenile Hall. Please refer to the Title 15 Procedures checklist for a summary of all relevant minimum standards, indication of compliance or noncompliance, and information that was used to determine compliance. Mandatory Local Inspections In addition to the biennial inspection, Title 15, section 1313 and its authorizing statute also require local inspections conducted by the following local authorities: • county building inspector or person designated by the Board of Supervisors • fire authority having jurisdiction • local health officer • county Superintendent of Schools • Juvenile Court • Juvenile Justice Commission. Results of those inspections are considered a part of this report. The dates of the local inspections may be found in the accompanying Procedures Checklist. 7673+7675 Stanislaus 18/20 LTR Chief Hamasaki Page 2 Scope of the Inspection The inspection consisted of a review of the Stanislaus County Policy and Procedure Manual1, a site visit to review operations, physical plant and relevant documentation, and interviews with administration, facility staff, youth and collaborative partners. During the inspection, we evaluated consistency between policy and practices. Inspection Results Title 15, CCR Minimum Standards During our inspection of the Stanislaus County Juvenile Hall and the Juvenile Commitment Facility, we reviewed the facility policies and procedures manual. Our audit consisted of a review of only those policies and procedures related specifically to the applicable regulations included in Title 15, Minimum Standards for Juvenile Facilities. On the day of the inspection, we discussed several policies and procedures with staff and suggested edits which might bring more clarity and specificity to the manual. We also discussed the need to include the updated Title 15 language in the policy and procedure manual to be in line with regulations which became effective January 1, 2019. All other agreed-upon changes were completed prior to the submission of this report. Upon initial review of documentation, the Juvenile Hall was deemed out of compliance with Title 15 section 1329 Suicide Prevention Plan and 1354.5 Room Confinement. Please refer to the procedural checklist for more details. Review of documentation provided initially revealed the Juvenile Hall facility was out of compliance with these regulations with regards to documentation of youth program involvement while on suicide watch and documentation on Special Incident Reports (SIR) submitted with predetermined room confinement for youth placed in room confinement. Following our inspection and debriefing, Superintendent Ferriera developed and implemented the Daily Program Observation Sheet for youth not participating in normal programming due to suicide watch, room confinement, etc. Superintendent Ferriera also sent a directive to all staff immediately ceasing the recommendations of predetermined room confinement time for youth placed on room confinement. Documentation verifying these corrective actions were provided to BSCC prior to the submission of this report. Upon final review of all documentation, there are no outstanding items of noncompliance with Title 15 at the Stanislaus County Juvenile Hall and Juvenile Commitment Facility. No corrective action is required at this time. Title 24, CCR Physical Plant There were no changes made to the physical plant and your rated capacity for the Juvenile Hall remains 158 youth and Juvenile Commitment Facility remains at 60 youth. Please see the Physical Plant Evaluation for more information. 1 BSCC reviews only those policy and procedures required by, and applicable to, Title 15, CCR. BSCC staff do not “approve” policies and procedures or assess them for constitutional or legal issues. Training Per the most recent Standards and Training for Corrections audit, Stanislaus County Probation Department is in compliance with all relevant regulations and mandates and mitigating circumstances if applicable. Juvenile Justice and Delinquency Prevention Act (JJDPA) Compliance Monitoring We reviewed applicable documentation, and found no violations of the JJDPA. Prior to the submission of this report Superintendent Ferriera sent documentation verifying the above policy changes and staff directive with regards to completing SIR’s of youth placed on room confinement. Although no youth has been held past the four-hour room confinement threshold, we also provided technical assistance with regards to documentation of youth’s total room confinement and efforts made to re- integrate the youth back in normal programming.
