July 31, 2019 Brandon Barnes, Sheriff – Coroner Sutter County Sheriff’s Department 1077 Civic Center Blvd. Yuba City, Ca 95993 2018-2020 BIENNIAL INSPECTION OF SUTTER COUNTY SHERIFF’S DEPARTMENT JAIL, PENAL CODE 6031 Dear Sheriff Barnes: On April 11, 2019, staff of the Board of State and Community Corrections (BSCC) conducted the 2018-2020 biennial inspection of the Sutter County Jail Facility. A pre-inspection briefing was held on February 21, 2019. At the time of the biennial inspection, the BSCC conducted the pre-opening inspection of your AB900 Jail Expansion Project. The Title 24 checklist is attached and your facility meets all of the required Title 24 Minimum Standards. Pursuant to Penal Code Section 6031, this inspection was performed to determine compliance with the Minimum Standards for Local Detention Facilities as outlined in Titles 15 and 24, California Code of Regulations (CCR). In addition, BSCC staff conducted compliance monitoring pursuant to Welfare and Institutions Code Section 209(f) for the federal Juvenile Justice and Delinquency Prevention Act (JJDPA). The complete BSCC inspection report is enclosed and consists of: this transmittal letter; the Title 15 Procedures Checklist outlining applicable minimum standards; a Physical Plant Evaluation outlining Title 24 requirements for design; and, a Living Area Space Evaluation summarizing the physical plant configuration and showing the capacity of the facility. Refer to the Title 15 Checklist for indication of compliance status and evidence used to determine compliance. LOCAL INSPECTIONS In addition to the biennial inspection by the BSCC, inspections are also required annually by the County Health Officer and biennially by the State Fire Marshal or an authorized representative (Health and Safety Code Sections 101045 and 13146.1). Please consider our report in conjunction with the reports from the County Health Officer and the respective fire authorities for a comprehensive perspective of your facilities. All local inspections were up to date with the exception of the biennial fire life and safety inspection. Please forward current inspection results as they become available. Title 15, CCR Inspection Our evaluation consisted of reviewing only those policies and procedures related specifically to the applicable regulations included in Title 15, CCR.1 We found the following item of noncompliance at the Sutter County Jail Facility: Title 15, Section 1027 Number of Personnel: A sampling of safety checks was reviewed by BSCC staff through the documentation provided by the agency. The documentation disclosed safety checks throughout the facility were not being routinely completed within the required 60-minute time frame of this regulation. Title 15, Section 1027.5 Safety Checks: A sampling of safety checks was reviewed by BSCC staff through the documentation provided by the agency. The documentation disclosed safety checks throughout the facilities were not being routinely completed within the required 60-minute time frame of this regulation. Title 15, Section 1029 Policy and Procedures Manual: This regulation requires a publicly posted method for uninvolved inmates, family, community members, and other interested third-parties to report sexual abuse or sexual harassment. During the inspection there was no such public posting observed. Title 15, Section 1032 Fire Suppression Preplanning: Section (C) of this regulation requires fire prevention inspections as required by Health and Safety Code Section 13146.1(a) and (b) which requires inspections at least once every two years. The last fire inspection was conducted on 08/08/17. Title 15, Section Communicable Diseases: This regulation requires the facility administrator, in cooperation with the responsible physician to develop written policies specifying observable symptoms for communicable disease. During our review of your policy, we were unable to locate a listing of any specific observable symptoms of communicable disease. Title 15, Section 1055 Use of Safety Cell: Continued retention approvals were not compliant with the regulation requirement of every four hours. Please refer to the Procedures Checklist for detailed information. 1 BSCC does not review all policies and procedures. We do not “approve” policies and procedures nor do we review them for constitutional or legal issues. The changes made to the physical plant have been inspected for Title 24 requirements and there are no areas of deficiencies noted. Juvenile Justice and Delinquency Prevention Act Compliance Monitoring The BSCC monitors local detention facilities for compliance with the JJDPA. Minors are not held at the Sutter County Jail. Corrective Action Plan If you choose to address the noncompliance issues noted above, please provide corrective action so that we may update our files to indicate compliance.
