March 22, 2019 Dave Hencratt, Sheriff-Coroner Tehama County Sheriff’s Office PO Box 729 Red Bluff, CA 96080 Dear Sheriff Hencratt: 2018-2019 BIENNIAL INSPECTION OF TEHAMA COUNTY SHERIFF’S OFFICE JAIL AND COURT HOLING FACILITY, PENAL CODE 6031 Dear Sheriff Hencratt, On February 21, 2019, staff of the Board of State and Community Corrections (BSCC) conducted the 2018-2020 biennial inspection of the Tehama County Jail and Court Holding Facility. A pre-inspection briefing was held on January 10, 2019. Pursuant to Penal Code Section 6031, this inspection was performed to determine compliance with the Minimum Standards for Local Detention Facilities as outlined in Titles 15 and 24, California Code of Regulations (CCR). In addition, BSCC staff conducted compliance monitoring pursuant to Welfare and Institutions Code Section 209(f) for the federal Juvenile Justice and Delinquency Prevention Act (JJDPA). The complete BSCC inspection report is enclosed and consists of: this transmittal letter; the Title 15 Procedures Checklists outlining applicable minimum standards; the Physical Plant Evaluations outlining Title 24 requirements for design; and the Living Area Space Evaluations summarizing the physical plant configurations and showing the capacity of the facilities. Refer to the Title 15 Procedures Checklists for indication of compliance status and evidence used to determine compliance. LOCAL INSPECTIONS In addition to the biennial inspection by the BSCC, inspections are also required annually by the County Health Officer and biennially by the State Fire Marshal or an authorized representative (Health and Safety Code Sections 101045 and 13146.1). Please consider our report in conjunction with the reports from the County Health Officer and the respective fire authorities for a comprehensive perspective of your facilities. Local inspection reports are forwarded to your office under separate cover. Each of the local inspections were current except for your Environmental Health inspection at the Court Holding Facility on the day of the inspection. Prior to completing this letter, Sergeant C. Tehama County Jail: Title 15, CCR Inspection Our evaluation consisted of reviewing only those policies and procedures related specifically to the applicable regulations included in Title 15, CCR.1 We found the following items of noncompliance. Title 15, Section 1027.5 Safety Checks: As noted in the 2016-2018 Biennial inspection report, safety checks continue to have intermittent time gaps between checks with the handheld scanners. After further review of safety check documentation, we determined safety checks in several housing units were not completed within the 60-minutes required by this section. Please refer to the Procedures Checklist for detailed information. Title 24, CCR Physical Plant There were no changes made to the physical plant and your rated capacity remains at 191. We found one item of noncompliance. Title 24, Section 1231.2.8 Dormitories: Yellow Unit has an RC of 42 and S-105 a RC of 32. On the day of inspection, S-104 held 44 inmates and Yellow Unit held 36 inmates. Therefore, a finding of noncompliance was determined for this section. Please refer to the Physical Plant Checklist for detailed information. 1 BSCC does not review all policies and procedures. Juvenile Justice and Delinquency Prevention Act Compliance Monitoring The BSCC monitors local detention facilities for compliance with the JJDPA. Minors are not held at the Tehama County Jail or the Court Holding Facility. Therefore, a finding of noncompliance was determined with this section. We were informed by jail supervisory staff they are seeking approval from the Tehama County Board of Supervisors to sole source a contract with their current electronic security contractor to provide a new safety check verification system. BSCC staff also provided technical assistance by discussing compliance monitoring techniques for shift supervisors to self-audit safety checks until a new system can be procured. In accordance with Penal Code 3407 the policy shall include reference to the following: (1) An inmate known to be pregnant or in recovery after 512 Use of Restraints delivery shall not be restrained by the use of leg irons, waist X 512.9.1 Inmates in Labor chains, or handcuffs behind the body. (2) A pregnant inmate in labor, during delivery, or in 512 Use of Restraints recovery after delivery, shall not be restrained by the wrists, 512.9.1 Inmates in Labor X ankles, or both, unless deemed necessary for the safety and security of the inmate, the staff, or the public. (3) Restraints shall be removed when a professional who is 512 Use of Restraints currently responsible for the medical care of a pregnant 512.9.1 Inmates in Labor inmate during a medical emergency, labor, delivery, or X recovery after delivery determines that the removal of restraints is medically necessary. 5800 Tehama Co Jail PRO 2018-2020; 2/21/19 - 13 - A353 Type 2&3 PRO eff. 1/2019 (18-20).dot TITLE 15 SECTION YES NO N/A P/P REFERENCE – COMMENTS (4) Upon confirmation of an inmate's pregnancy, she shall 503.2.1(q) Initial Orientation be advised, orally or in writing, of the standards and policies governing pregnant inmates. Information is provided to female inmates during the kiosk orientation. The kiosk orientation must be completed by all inmates prior to them being allowed access to the system to order commissary, review jail policies and schedule visits. During our interview of inmates to verify the content and use of the kiosk, one inmate demonstrated the features kiosks. The inmate went through the various screens and how the orientation process worked. The inmate demonstrated the ease of use and where to locate the rules and regulations, policies and X information pertaining to this section for pregnant inmate’s. On the day of the inspection, Tehama County only had one inmate in custody who was pregnant. During our interview with her, she informed us she was aware of the information regarding pregnant inmates and the use of restraints. She also said the information is located on the kiosk if she had any questions. The kiosks are available to all inmates in the facility. 1059 USE OF REASONABLE FORCE TO 519 Biological Samples COLLECT DNA SPECIMENS, SAMPLES, 519.5 Calculated Use of Force to Obtain IMPRESSIONS Samples (a) Pursuant to Penal Code Section 298.1, authorized law enforcement, custodial, or corrections personnel including X peace officers, may employ reasonable force to collect blood specimens, saliva samples, or thumb or palm print impressions from individuals who are required to provide such samples, specimens or impressions pursuant to Penal Code Section 296 and who refuse following written or oral request. (TYPE II ONLY) 1010 - Inmate Visitation All inmates in Type II facilities are allowed at least two X visits totaling at least one hour per inmate each week. (TYPE III ONLY) Inmates in Type III facilities are allowed one or more X visits, totaling at least one hour per week.
