Dear Sheriff Saxon:
On November 13, 2019, staff of the Board of State and Community Corrections (BSCC) conducted the
2018-2020 biennial inspection of the Trinity County Jail.
Pursuant to Penal Code Section 6031, this inspection was performed to determine compliance with the Minimum
Standards for Local Detention Facilities as outlined in Titles 15 and 24, California Code of Regulations (CCR). In
addition, BSCC staff conducted compliance monitoring pursuant to the federal Juvenile Justice and Delinquency
Prevention Act (JJPDA) for the separation requirements of juveniles from incarcerated adults.
The complete BSCC inspection report is enclosed and consists of: this transmittal letter; the Title 15 Procedures
Checklist outlining applicable minimum standards; a Physical Plant Evaluation outlining Title 24 requirements for
design; and, a Living Area Space Evaluation summarizing the physical plant configuration and showing the capacity
of the facility. Refer to the Title 15 Checklist for indication of compliance status and evidence used to determine
compliance.
LOCAL INSPECTIONS
In addition to the biennial inspection by the BSCC, inspections are also required annually by the County Health
Officer and biennially by the State Fire Marshal or an authorized representative (Health and Safety Code Sections
101045 and 13146.1). Please consider our report in conjunction with the reports from the County Health Officer
and the respective fire authorities for a comprehensive perspective of your facilities. Local inspection reports are
forwarded to your office under a separate cover. Each of the local inspections were current.

BSCC INSPECTION
The inspection consisted of a review of the Trinity County Sheriff’s Office Custody Services Manual and sections
of the Trinity County Sheriff’s Office Policy Manual that apply to Jail Operations, a site visit to review operations,
physical plant and relevant documentation, and interviews with administration and facility staff.

Title 15, CCR Inspection
Our evaluation consisted of reviewing only those policies and procedures related specifically to the applicable
regulations included in Title 15, CCR.1 We found the following items of noncompliance.
Title 15, Section 1027, Number of Personnel:
A sufficient number of personnel shall be employed in each local detention facility to ensure the
implementation and operation of the programs and activities required by these regulations. Additionally,
whenever one or more female inmates are in custody, there shall be at least one female employee who
shall be immediately available and accessible to such females.
Currently, as has been identified in the last three inspection cycles, staffing retention and recruitment
remain a significant challenge. Authorized staffing does not account for adequate backfill for coverage
during long-term absences of personnel. A review of safety checks identified that there are times when
there are not adequate personnel on duty to conduct safety checks and times that there are not female
staff available for female inmates.
Title 15, Section 1027.5, Safety Checks:
Safety checks shall be conducted at least hourly through direct visual observation of all inmates. There
shall be no more than 60-minute lapse between safety checks.
As stated above, several months of safety checks were reviewed and were found to be inconsistent and do
not meet the time requirements.
Title 15, Section 1029, Policies and Procedures Manual:
The policy and procedures manual shall address all applicable Title 15 and Title 24 regulations and shall
be comprehensively reviewed and updated at least every two years. Such a manual shall be made available
to all employees.
The current Custody Manual was revised and dated July 07, 2016.
Title 15, Section 1056, Use of the Sobering Cell:
The sobering cell described in Title 24, Part 2, Section 1231.2.4, shall be used for the holding of inmates
who are a threat to their own safety or the safety of others due to their state of intoxication and pursuant
to written policies and procedures developed by the facility administrator. Additionally, at 12 hours from
the time of placement, all inmates will receive an evaluation by responsible health care staff.
Currently, because the facility lacks a safety cell and has only one sobering cell, inmates that are violent
or need extended separation are left in the cell past the time needed for sobering and/or over six hours.
Some inmates that who are a threat to themselves or others do to their intoxication are not placed in a
sobering cell due to it being utilized for other arrestees. In these cases, the inmate is placed in a visitation

room that does not have toilet, fountain, or wash basin. Staff continues to have to make housing decisions
based on level of intoxication, threat, and gender.
Finally, the manual is out of date for this section, in that there is not a required health care review of
inmates placed in sobering for over 12 hours.
Title 15, Section 1058 Use of Restraint Devices:
Inmates shall be placed in restraints only with the approval of the facility manager, the facility watch
commander, responsible health care staff; continued retention shall be reviewed a minimum of every hour.
A medical opinion on placement and retention shall be secured within one hour from the time of placement.
A medical assessment shall be completed within four hours of placement.
Currently, the manual is out of date for this section. The approval, medical opinion, and medical
assessment time limits need to be updated and implemented.

Title 24, CCR Physical Plant
There were no changes made to the physical plant and the rated capacity remains at 53. The Jail was originally
constructed under the 1973 Title 24 Regulations, and there were additions of a single housing cell and two
dormitories added under the 1988 regulations. Finally, second double beds were added to two of the single cells,
under the 1994 regulations. On the date of the inspections, the facility was at 55 in-custody.
Title 24, Noncompliance Issues
Title 24, Section 2.6 Single Occupancy Cells:
4/73 Regulation, the Single Occupancy Cell has a maximum capacity of one inmate and limited by dayroom
space. Currently, the holding cell in the booking area was rerated as a single occupancy cell. It is now
being occupied with two beds and housing two inmates.
Title 24, Section 8227 Multiple Occupancy Cells
4/73 Regulation required 25 Square Feet per Inmate. Housing Unit A-2 contained additional bunks over
the 4 rated capacity. All bunks were in use at the time of the inspection.
Juvenile Justice and Delinquency Prevention Act Compliance
In accordance with JJDPA. BSCC monitors jail facilities for compliance with one of four core requirements of the
Act, Separation of Juveniles from Incarcerated Adults. Minors are not housed at this facility; therefore, no violations
of the JJDPA were identified.
Corrective Action Plan
If you choose to address the noncompliance issues noted above, please provide a corrective action plan so that we
may update our files to indicate compliance.
