May 1, 2018 Michael Boudreaux, Sheriff-Coroner Tulare County Sheriff's Department County Civic Center Visalia, CA 93291-4580 Dear Sheriff Boudreaux: BIENNIAL INSPECTION, TULARE COUNTY COURT HOLDING FACILITIES PENAL CODE SECTION 6031 On March 15, 2018, the Board of State and Community Corrections (BSCC) conducted the 2016-2018 Biennial Inspection of the Tulare County Sheriff’s Office court holding facilities. The locations included: the Visalia Superior Court (VCH), the Pre-Trial Court Holding Facility (PTCH), and the Porterville Superior Court (PCH). The Dinuba court holding facility was not inspected, as your department is no longer using these holding cells. The facilities were inspected for compliance with the Minimum Standards for Local Detention Facilities, as outlined in Titles 15 and 24, California Code of Regulations. The inspection consisted of a site visit of each physical plant, a review of applicable written policies and procedures governing the operation of each facility, and a review of documentation to verify that your practices follow your written procedures and Title 15. We would like to acknowledge members of your department for their assistance and courtesy during the inspection process. This includes: Lieutenant Alfred Galafate, Sergeant Mark Wallace and Deputy Sidney Hammond. The assistance provided by your staff in responding to our requests for copies of policies, procedures, and documentation is appreciated. They coordinated and accompanied us during the site visits, clarified processes, and answered questions. The complete inspection report is enclosed and consists of: this letter; a Procedures Checklist outlining applicable Title 15 sections for all court holding facilities; the Physical Plant Evaluations, outlining Title 24 requirements for each facility’s construction design, and the Living Area Space Evaluations that summarize each court holding facility’s rated capacity. This letter is organized into sections that address the Tulare County court holding facilities as a system, and then each facility individually. We encourage the practice of maintaining a permanent file to retain historical copies of all inspections, including corrective action plans. This file should be the first point of reference when preparing for all future inspections. Local Inspections In addition to a biennial inspection by the BSCC, annual inspections are required by the County Health Officer and the State Fire Marshal (SFM), or their designated representative, pursuant to Health and Safety Code §101045 and § 13146.1 respectively. Fire Inspections Statute requires the SFM, or their authorized representative, to inspect your facilities at least once every two years, and the SFM inspected the Pre-Trial, Porterville and Visalia Court Holding facilities on October 26, 2017. Fire clearance was granted and they are current with the fire and life safety inspection requirement. Health Inspections The Tulare County Health Department conducted the health inspections, including a review of the medical/mental health, nutritional, and environmental health policies and procedures, as well as an inspection of practices. The Health Department verbally confirmed that their inspections are complete; however, we have not received the final written reports. Please forward these reports to the BSCC once you receive them. BSCC Inspection Title 15 Policies and Procedures (System-wide) We conducted a review of the Court Services Division manual, which is a consolidated policy and procedures manual, applicable for the operations of all the court holding facilities in Tulare County. Our review is focused on policies and procedures applicable to Title 15 regulations. Non-Compliance There were no issues of non-compliance. Detention of Minors The Porterville Court Holding facility is designed with holding cells, in the basement, for juveniles with a separate sally port and elevator to the juvenile courts. The County Probation Department does not staff these holding cells, and the Sheriff’s Department uses them to separate female inmates from the males. The County Probation Department uses this sally port to escort juveniles to the court via this separate elevator, which is separated from the adult court holding cells. The Pre-Trial and Visalia Court Holding facilities do not detain minors. Physical Plant Inspections The inspection process continued at each facility with a site visit, a review of available documentation, and interviews with staff to ensure that practices are consistent with policies.
