Dear Sheriff Pooley: On March 23, 2022, staff of the Board of State and Community Corrections (BSCC) provided pre- inspection briefings to facility supervisors outlining the proposes, process, and necessary documentation needed for the biennial inspection. Staff gave participants a complete preview of the visit and provided a schedule of the inspection. BSCC staff provided applicable checklists and answered any questions. On June 14 and 15, 2022, the 2020-2022 biennial inspection of the Jack Dambacher Detention Center and Tuolumne Superior Court Holding was completed pursuant to Penal Code Section 6031. These inspections were performed to determine compliance with the Minimum Standards for Local Detention Facilities as outlined in Titles 15 and 24, California Code of Regulations. In addition, BSCC staff conducted compliance monitoring pursuant to Welfare and Institutions Code Section 209(f) for the federal Juvenile Justice and Delinquency Prevention Act (JJDPA) for the separation requirements of juveniles from incarcerated adults. The complete BSCC inspection report is enclosed and consists of this transmittal letter; the Procedures Checklists outlining applicable Title 15 sections for both custody and court holding facilities; and individual Physical Plant Evaluations and Living Area Space Evaluations that summarize each facility’s physical plant configuration. We encourage the practice of maintaining a permanent file for historical copies of all inspections that would also include documentation of corrections made following the inspection. This file should be the first point of reference when preparing for all future inspections. LOCAL INSPECTIONS In addition to the biennial inspection by the BSCC, inspections are also required annually by the County Health Officer and biennially by the State Fire Marshal or an authorized representative (Health and Safety Code Sections 101045 and 13146.1). Inspection Detention Center Superior Court Holding Fire and Life Safety 4/25/2022 8/19/2021 Medical and Mental Health 12/07/2021 12/07/2021 Nutritional Health 12/28/2021 N/A Environmental Health 12/07/2021 12/07/2021 BSCC INSPECTION Jack Dambacher Detention Center (County Jail) Title 15, CCR – Procedural and Operational Review (County Jail): The inspection consisted of a review of the Tuolumne County Sheriff’s Office Policy and Procedure Manual1, a site visit to review operations, physical plant, relevant documentation, and interviews with administration, facility staff, inmates, and collaborative partners. In reviewing policies and procedures during the 2020-2022 cycle, consideration was given to agency’s Emergency Suspension of Services (ESS) related to the COVID-19 emergency measures taken and authorized by the BSCC. For the safety of the inmates and staff, the Tuolumne County Sheriff’s Office had periodically suspended the following services during part or whole of this inspection cycle: Section 1061, Inmate Education Programs (March 13, 2020 – August 30, 2021) Section 1062, Visitation (December 1, 2020 – January 29, 2021) Section 1065, Exercise and Recreation (November 9, 2021 – November 25, 2021) Section 1070, Individual/Family Service Programs (March 13, 2020 – March 28, 2022) Section 1072, Religious Observances (March 13, 2020 – March 28, 2022) BSCC Staff reviewed policy and procedures for these sections and any mitigation measures taken to minimize the impact of the suspension of these services. No items of noncompliance were identified. Title 24, CCR - Physical Plant (County Jail): There were no changes made to the physical plant and rated capacity remains at 234. Please see the Physical Plant Evaluation Checklist for more information. On the date of the inspection, the facility was holding 127 persons in custody. There are no outstanding items of noncompliance with Title 24 minimum standards. 1BSCC reviews only those policy and procedures required by, and applicable to, Title 15, CCR. BSCC staff do not “approve” policies and procedures or assess them for constitutional or legal issues. Agencies should seek review through their legal advisor, risk manager, and other persons deemed appropriate for such evaluation. 5958 5957 Tuolumne County SO LTR 20-22 Bill Pooley Sheriff Page 3 Tuolumne Superior Court Holding Title 15, CCR – Procedural and Operational Review Inspection (Court Holding): No items of noncompliance were identified. Title 24, CCR - Physical Plant (Court Holding): No items of noncompliance were identified. Juvenile Justice and Delinquency Prevention Act (JJDPA) Compliance Monitoring Minors are not held at the Main Jail and any minor in attendance at the Tuolumne County Superior Court is held in a separate area under the control and supervision of the Tuolumne County Probation Department. No violations of the JJDPA were found. Corrective Action Plan There is no need for a corrective action plan. Technical Assistance At the conclusion of each inspection, BSCC staff offered an out brief of findings to the Sheriff and facility management. This included an extensive discussion of the impact of staffing levels, recruitment, and retention of qualified custody personnel. The current number of authorized personnel is adequate for the operation of the facilities and all associated programs, but the 25% shortfall in staffing will eventually cause problems with meeting minimum requirements and result in non-compliance issues. At present, through mandated overtime, custody staff is completing safety checks and of security functions as directed. As discussed, this staffing situation will cause closure of parts of the facility, reduction in programs for inmates, concerns of health and safety of staff and inmates, contracting with outside agencies, and degradation of the very new facility. This is a high priority with continued challenges like competitive agencies, comparable job salaries, and smaller recruitment pool. With a concerted county effort to bring staffing up to the authored level and retain jail staff, the downside of the low staffing may be avoided. -- This concludes our inspection report for the 2020-2022 biennial inspection cycle of the Tuolumne County Jail and Superior Court Holding Facility.
