October 10, 2018 Geoff Dean, Sheriff Ventura County Sheriff’s Office 800 South Victoria Avenue Ventura, CA 93009 Dear Sheriff Dean: BIENNIAL INSPECTION, VENTURA COUNTY SHERIFF’S OFFICE, ADULT DETENTION FACILITIES, PENAL CODE SECTION 6031 During the week of May 16, 2018, the Board of State and Community Corrections (BSCC) conducted the 2016-2018 biennial inspection of the Ventura County Jails and court holding facilities. The facilities were inspected for compliance with the Minimum Standards for Local Detention Facilities, as outlined in Titles 15 and 24, California Code of Regulations. The inspection consisted of a review of applicable written policies and procedures governing the operation of the facilities, site visits, and a review of documentation to verify that regulated practices occur as required. Commanders Cheryl Wade and Ron Nelson, Captains Mark Franke and Cory Rubright, Sergeants Hector Macias and Bea Hughes and Legal Unit Supervisor Tracy Aguilar were instrumental in the inspection process and your facilities were well prepared for our visit. The complete BSCC inspection report is enclosed and consists of: this transmittal letter; the Procedures checklists outlining applicable Title 15 sections for both jail and court holding facilities; and individual Physical Plant Evaluations and Living Area Space Evaluations that summarize each facility’s physical plant configuration. We encourage the practice of maintaining a permanent file for historical copies of all inspections that would also include documentation of corrections made following the inspections. This file should be the first point of reference when preparing for all future inspections and inquiries. Fire inspections for court holding facilities are overdue, leading to the following issue of non-compliance: Title 15 Section 1032: Fire Suppression Preplanning – This regulation requires fire prevention inspection at least once every two years. Inspections are overdue for all court holding facilities. Medical and environmental inspections are overdue for all court holding facilities. Please forward those inspection results as they become available. BSCC Inspection Title 24 Inspection - Physical Plant Generally, jails are designed in accordance with Title 24 standards which establish the capacity of cells based on living space, recreational space and fixtures such as toilets, washbasins and showers. Pre-Trial Facility: Completed in 1981, the Pre-Trial Facility was evaluated using physical plant standards from 1976, 1998 and 2001.1 The facility houses an intake unit, medical suites and security housing in single and double cell configurations with a rated capacity of 823 inmates. The facility housed 658 inmates during our visit. Housing is configured in 32 pods, each containing space for 1 Facilities are evaluated against the versions of Title 24 in effect at the time of construction or significant remodel. Each pod is divided into cells clustered around a dayroom which is used for recreation. The facility was built in a high-security design (all one- or two-person cells) and lacks high-density, lower-security housing (dormitories). Inmates are assigned housing pods based, in part, on their risk assessment and classification. As a result, the facility has little space for expansion and, when crowded in a specific classification, assigns inmates to bunk beds in the dayroom areas of the appropriate pod. Due to the high security level of inmates being held, the facility lacks balanced housing options between incompatible classifications and some pods were crowded while others had empty cells. At the time of our site visit, seven of 32 pods had occupied bunk beds in the dayrooms. When dayrooms are reconfigured as housing areas, the following area of non-compliance exists: Title 24 Section 1231.2.9 Dayrooms: This regulation requires 35 square feet of dayroom space for each inmate assigned to its use. We observed units B, C, D and H to have occupied bunks in their dayrooms, reducing dayroom space below this minimum standard. Todd Road Jail: This facility was opened in 1994 and is evaluated using physical plant standards from 1988. The facility is designed in a high-security configuration of 25 pods, each containing double-occupancy cells surrounding a dayroom, yielding a rated capacity of 796 inmates. Due to classification, some pods were crowded with overflow inmates housed on bunkbeds in the dayrooms. At the time of our site visit, 18 or 25 pods had occupied bunks in the dayroom to house the overflow inmates. Due to crowding, the following issue of non-compliance was noted: Title 24 Section 1231.2.9 Dayrooms: This regulation requires 35 square feet of dayroom space for each inmate assigned to its use. We observed that all units (A-D) have occupied bunks in their dayrooms, reducing dayroom space below this minimum standard. East Valley Jail: This facility was opened in 1989 and is evaluated using physical plant standards from 1980. The facility has a rated capacity of 31 inmates, all held in single-occupancy cells or dormitory housing. The facility is commonly used as a booking station for agencies in the area and the duration of confinement is generally less than six hours. Dormitory housing is available for inmate workers reassigned from other jails. On the day of our inspection, the facility held one inmate. No items of non-compliance were noted. Court Holding Facilities: The Hall of Justice and Juvenile Justice Center court holding facilities are unchanged since the last inspection. We toured both facilities and noted no evidence of Title 24 issues. The East Valley court holding facility is out of service but is kept open and available if needed. During our site visits, we were able to view all housing units and service areas. We noted a high level of cleanliness and maintenance. No evidence of deferred maintenance was noted. Regarding the physical plants, no other issues of non-compliance were noted. All facilities were exceptionally clean and well-maintained. Title 15 Inspection – Operational Review During the inspection, BSCC staff reviewed applicable policy, procedures, practices and supporting documentation as indicated. 5960 + Ventura II I CH 16-18 Ltr: 10/10/18 Geoff Dean, Sheriff Page 4 Policy 2– Facilities are governed by the Departmental Policy manual, the Detention Services Division Manual, and individual Operating Procedures for each facility. A specialized manual exists for the courts, including court holding functions. All policies are reviewed annually and revised as needed. The most current revision is 2018. All regulated functions were found in policy and no issues of non-compliance were noted. Training –The most recent Standards and Training for Corrections (STC) audit (July 2017) found the agency in compliance with all training requirements. We interviewed line staff and found them knowledgeable about emergency procedures, Title 15 standards and related issues. Deputies that supervise inmates are also POST-trained peace officers and are often veterans of patrol and investigative assignments in the field. The extra training and experience afforded to these deputies is seen in the facilities as staff appears comfortable and engaged when working with the inmates and handling high-stress situations. The agency has implemented programs to both increase training opportunities for staff and capitalize on the experience of seasoned deputies. The “Shift Lead” position brings experienced patrol deputies with prior jail experience back into the jails to mentor newer deputies in inmate interaction and interpersonal skills. The “Senior Deputy” position offers experienced jail deputies with closely- supervised opportunities to oversee a shift or project, supervise subordinates and better prepare them for promotion and added responsibility. Procedures - BSCC also reviewed a variety of records to ensure that procedures relevant to Title 15 standards matched policy and that all required procedures were being performed within regulated criteria. To assess the facility’s staffing levels, BSCC reviewed security logs, shift rosters, incident reports, and related records which give insight to the facility’s operation. For the housing units, records of time-sensitive events, including meal and laundry services, safety checks, recreation movements and non-professional visiting, are kept in automated journals. We noted that safety checks were consistently timely. Out of cell opportunities, made more difficult by classifications of inmates housed in the common dayroom areas, are documented. We reviewed grievances and did not note persistent complaints about missed recreation, visits, laundry exchanges or other activities which are often delayed in understaffed or crowded facilities. Grievances were all reviewed by both a supervisor and the legal services unit and were accepted for any condition of confinement. Responses to grievances were comprehensive and referred to policy or statute. We interviewed inmates at each jail and sought out complaints related to crowding, such as cold food, missed recreation times or lack of programming, but no such complaints were noted. Intake medical screening is conducted by trained staff and a medical professional assesses all inmates prior to housing. Overall, despite the crowded conditions, we found no indication that staffing was insufficient to meet the minimum standards. 2 BSCC does not review all your policies and procedures. We only review those policies related specifically to the applicable regulations included in Title 15, Minimum Standards for Local Detention Facilities for issues on non-compliance. We do not “approve” your policies nor do we review them for constitutional or legal issues. We recommend agencies seek policy review through their legal advisor, risk manager, and other people deemed appropriate. 5960 + Ventura II I CH 16-18 Ltr: 10/10/18 Geoff Dean, Sheriff Page 5 Inmates in certain high-risk low-incidence conditions often require enhanced supervision in special use cells and equipment, such as sobering cells, safety cells and restraint chairs. Specialty cells are only available at the Pre-Trial and Todd Road facilities as the safety and sobering cells at East County jail have been closed. Restraint chair placement is only used at the Pre-Trial facility. Sobering Cells: Sobering cell logs at the jails revealed timely safety checks and supervisory oversight. Monitoring forms guide staff to record a comprehensive level of observations. We noted that all inebriates were assessed by medical staff at the time of placement and periodically during their recovery. Safety Cells: There are safety cells at both the Pre-Trial and Todd Road jails. Safety cells are used for violent or self-injurious inmates requiring mental health intervention. Lacking a restraint chair at Todd Road, we noted a higher incidence of safety cell placements than the Pre-Trial Facility. The need to place an inmate in the safety cell, along with the supervisor’s oversight, is recorded in an incident report for each placement. All required events, such as safety checks and offers of food and water, are recorded manually. A sampling of safety cell confinements was reviewed and all events and interventions by custody and medical staff were noted to be timely and complete. Supervisory and management oversight was evident and the level of documentation of observations was excellent. Restraints: Use of restraints is limited to the restraint chair and its use is documented by an incident report. Timed events, including safety checks, medical visits and hygiene offerings, are tracked on hand-written logs. BSCC reviewed a sampling of events and found documentation to be clear and comprehensive. Checks and interventions, including medical and supervisory checks, were consistently timely. Programming and educational offerings are widely available and include vocational, language, educational and substance abuse courses. Innovative programs such as veteran’s special services and child support review are also available. Operations in the court holding facilities are overseen by Sheriff’s sergeants. Classification and hazard information from the jail was effectively communicated to court staff on paper. Remanded arrestees are not mixed with jail inmates prior to classification and medical screening. Safety checks were timely and are recorded by hand. We also witnessed staff’s response to a serious assault by inmates on a legal visitor and observed that adequate staff and supervisors were available to deal with the emergency and the overall operation of the facility simultaneously.
