June 14, 2022 Dan Fruchtenicht, Chief Probation Officer Yolo County Probation Department 2780 East Gibson Road Woodland, CA. 95776 RE: 2020/2022 BIENNIAL INSPECTION PURSUANT TO WELFARE AND INSTITUTIONS CODE SECTION 209 AND 885 Dear Chief Fruchtenicht, The 2020/2022 biennial inspection of the Yolo County Probation Department’s Yolo Juvenile Detention Facility has been completed. A pre-inspection training was held on April 1 and 20, 2021 and September 24, 2021, and the facility was inspected between March 8-11 and 21, 2022. The debrief was held May 13, 2022. The complete Board of State and Community Corrections (BSCC) inspection report is enclosed and consists of the following: this transmittal letter; a Title 15 Procedures checklist, outlining applicable minimum standards for juvenile detention facilities; a Physical Plant Evaluation, outlining applicable Title 24 minimum standards; and the Living Area Space Evaluation (LASE), summarizing the physical plant configuration and outlining the rated capacity of the 40 juvenile 20 adult while collocated with Yolo County Sheriff’s Office. Please refer to the Title 15 Procedures checklist for a summary of all relevant minimum standards, indication of compliance or noncompliance, and information that was used to determine compliance. MANDATORY LOCAL INSPECTIONS In addition to the biennial inspection, Title 15, section 1313 and its authorizing statute also require local inspections conducted by the following local authorities: • county building inspector or person designated by the Board of Supervisors • fire authority having jurisdiction • local health officer • county Superintendent of Schools • Juvenile Court • Juvenile Justice Commission. Results of those inspections are considered a part of this report. The dates of the local inspections may be found in the accompanying Procedures Checklist. Dan Fruchtenicht Chief Probation Officer Page 2 Scope of the Inspection The inspection consisted of a review of the Yolo County Probation Department’s Policy and Procedure Manual1, a site visit to review operations, physical plant and relevant documentation, and interviews with administration, facility staff, youth and collaborative partners. During the inspection, we evaluated consistency between policy and practices. BSCC INSPECTION RESULTS Title 15, CCR Minimum Standards Upon final review of all documentation, there are no outstanding items of noncompliance with Title 15 at the Yolo County Juvenile Detention Facility. No corrective action is required at this time. Technical assistance was provided in various areas of operations as the facility transitioned from a higher population with Yolo County Youth and Federal Youth in custody through federal contract to a very low population with very few incidents occurring. Some changes were made to the facility documentation process and some forms were updated to enhance consistency with regulatory expectations. These changes were completed while we were onsite and within the Enhanced Inspection Process, (30 days following inspection) to ensure consistency. These changes were intended to address the consistency issues found as a result of a lack of incidents and brought to the attention of the Superintendent for review. We will continue to monitor in the coming months during announced and unannounced compliance visits to the facility to ensure continued compliance. Title 24, CCR Physical Plant There were changes made to the physical plant and your rated capacity has been changed to 60. Previously, as the facility had been collocated with the Yolo County Sheriff's Office, the rated capacity had been changed to 55. As adults are no longer being booked in the facility and are only being housed in Unit A, juveniles are again able to use the receiving area as needed and have full use of Unit B. The rated capacity for youth beds has been updated to 60. Please see the Physical Plant Evaluation for more information. Training According to the most recent Standards and Training for Corrections audit, Yolo County Probation Department is in compliance with all relevant regulations and mandates and mitigating circumstances if applicable for Years 19/20 and 20/21. Juvenile Justice and Delinquency Prevention Act (JJDPA) Compliance Monitoring We reviewed the Yolo County Juvenile Detention Facility and found no violations of the JJDPA. Please refer to Title 15 Procedures checklist for detailed information. -- 1 BSCC reviews only those policy and procedures required by, and applicable to, Title 15, CCR. BSCC staff do not “approve” policies and procedures or assess them for constitutional or legal issues. We were most impressed with how often the staff took the extra steps to work with the youth to deescalate their behaviors during incidents, often taking the youth out of the unit for a change of scenery, changing staff out or counseling them until the crisis passes which in turn led to the youth we interviewed speaking highly of the staff and their care. This report was updated on 3/31/22 and 4/22/22 to indicate that the areas needing correction were either corrected or were recommended to be corrected. The facility superintendent has worked tirelessly to address this issue with Public Health.
