September 10, 2020 Danin Fruchtenicht, Chief Probation Officer Yolo County Probation Department 2780 East Gibson Road Woodland, CA. 95776 RE: 2018 - 2020 BIENNIAL INSPECTION OF YOLO PROBATION DEPARTMENT, WELFARE AND INSTITUTIONS CODE SECTION 209; JUVENILE JUSTICE AND DELINQUENCY PREVENTION ACT Dear Chief Fruchtenicht: Pursuant to the California Welfare and Institutions Code Section 209, the BSCC shall conduct a biennial inspection of each juvenile facility used for confinement of minors for more than 24 hours. These inspections are performed to determine compliance with the Minimum Standards for Local Detention Facilities as outlined in Titles 15 and 24, California Code of Regulations. An onsite, pre inspection briefing was held April 26, 2019, for facility staff responsible for the inspection process. A policy review was initiated and completed on June 18, 2020 and all documentation was requested and subsequently reviewed by virtual desk audit. Due to the coronavirus pandemic and the issuance of statewide and local shelter‐in‐place orders, BSCC staff were prohibited from traveling and unable to complete on‐site inspections between March and July 2020. Statewide, regional trainings were held in preparation of new regulatory expectations. These trainings were held in December 2018 to introduce and educate staff on the expectations of the new regulations and to provide technical assistance and direction. The complete BSCC inspection report is enclosed and consists of this transmittal letter, the Title 15 Procedures Checklists for each facility outlining applicable minimum standards; a Physical Plant Evaluation for each facility outlining Title 24 requirements for design; and a Living Area Space Evaluation for each facility summarizing the physical plant configuration and showing the capacity of the facility. Please refer to the Title 15 procedures checklist for indication of facility compliance status and evidence used to determine compliance. Local Inspections In addition to the biennial inspection by the BSCC, Title 15, Section 1313 and statute also require an annual local inspection from the following: county building inspector or person designated by the Board of Supervisors, annual local health officer, annual county Superintendent of Schools; Juvenile Court and the Juvenile Justice Commission. A biennial inspection is required from the fire authority having jurisdiction. Please refer to the Title 15 procedures checklist for dates and specific notes regarding these inspections and consider our report in conjunction with all other 7743 Yolo JH 18-20 Chief Fruchtenicht Yolo County Probation Page 2 reports received for a comprehensive perspective of your facility. There are no outstanding areas of noncompliance in your local inspection reports: however, we were unable to obtain a copy of the medical/mental health report as it was unavailable at the time of our report. Inspection Scope and Results Title 15, CCR Minimum Standards Prior to the desk audit inspection, we began with a review of the Yolo County Probation Department Policy and Procedure Manual. Our evaluation consists of reviewing only those policies, procedures specifically related to the Juvenile Hall and applicable regulations included in Title 15, CCR1. We noted there were policies that were missing information or inconsistent with the new requirements of the regulations. There were areas of policy and procedures that required various levels of improvement and corrective action. These areas were addressed and corrected and all are now current and consistent with regulation requirements. We reviewed documentation which included facility incident reports such as suicide watch, use of force, use of force with the use of OC, and restraints for movement within the facility. We reviewed room confinement forms, grievances, programming sheets, admission, release and classification documents, assessments and case plans, unit schedules, due process, and safety checks. All documentation was readily made available for our review to ensure compliance with Title 15 regulations and to ensure facility operations and policy/practice are consistent with regulatory expectations. We provided several technical assistance and best-practice recommendations to your management team to support their efforts in providing best practice services to the youth of Yolo County. Completing an inspection remotely and virtually does not allow for our regular onsite experiences that assist in the overall determination of compliance. This includes the onsite tour of the facility, observation of daily programs, activities and operations, face to face interviews with facility partners, staff and residents and the ability to observe and make a determination of the culture and environment of the facility. We also miss the opportunity to meet one on one to debrief our findings and to allow for technical assistance and best practice suggestions to be implemented if appropriate. BSCC staff intend to conduct comprehensive on‐site inspections of all local detention facilities as soon as travel restrictions are lifted, and we look forward to returning to the Yolo County Juvenile Detention Facility for a full inspection as soon as we are able. Upon final review of all documentation and upon the conclusion of this report, there are no outstanding areas of non-compliance. Title 24, CCR Physical Plant Since the last BSCC biennial inspection, the facility has been approved to be collocated with the Yolo County Sheriff’s Department, Monroe Detention Center. The Sheriff’s Department now utilizes 1 housing unit and the intake unit of the facility. The rated capacity of the facility has been adjusted and is now as follows: 1 BSCC does not review all policies and procedures. We do not “approve” policies and procedures, nor do we review them for constitutional or legal issues. Training The most recent Standards and Training for Corrections audit reports that the Yolo County Probation Department is in full compliance with all relevant regulations and mandates. Juvenile Justice and Delinquency Prevention Act Compliance Monitoring There have been no violations of JJDPA this inspection cycle and no areas of non-compliance were noted. As a collocated facility, the facility will be inspected separately to ensure compliance with all federal requirements for collocated facilities.
