THIS IS A LEGAL NOTICE NOTICE OF PUBLIC HEARING FRESNO LOCAL AGENCY FORMATION COMMISSION NOTICE IS HEREBY GIVEN that the Fresno Local Agency Formation Commission (LAFCo) will consider Municipal Service Reviews and Sphere of Influence Updates for the following Special Districts at a public hearing on March 13, 2013: Broadview, International, Mid-Valley, Oro Loma, Stinson, and Widren Water Districts and Freewater County Water District. LAFCo is responsible for reviewing the adopted spheres of influence (SOI) for special districts in Fresno County (Government Code section 56425). Municipal Service Reviews (MSRs) involve analyzing an agency's services and making determinations. The Commission is required to adopt written determinations regarding six specific topics. LAFCo has reviewed the SOis and has prepared MSRs for the above Districts. The Commission will consider the information, recommendations, and determinations in these studies at its March 13, 2013 hearing. At this hearing the Commission will also consider adopting the MSRs, with or without amendments, and make determinations pursuant to the California Government Code Section 56430(a). The Commission will also determine whether each special district's current Sphere of Influence is sufficient or whether such Sphere should be revised. Summary / Background The Cortese-Knox-Hertzberg Local Government Reorganization Act of 2000 requires LAFCo to review and update, as necessary, special district Spheres of Influence (SOis) every five years. Prior to, or in conjunction with an agency's SOI update, LAFCo is required to conduct a Municipal Setvice Review (MSR) for each agency. Municipal Service Reviews provide a comprehensive review of the services provided by a city or district and present recommendations with regard to the condition and adequacy of these services and/whether or not modifications to a city or district's SOI are necessary. MSRs can be used as informational tools by LAFCo and local agencies in evaluating the efficiencies of current district operations and may suggest changes in order to better serve the public. Sphere of Influence updates may involve an affirmation of the existing SOI boundaries or recommend modifications to the SOI boundaries. LAFCo is not required to initiate changes to an SOI based on findings and recommendations of the service review, although it does have the power to do so. State law requires that the Commission adopt written MSR determinations for each of the following seven criteria: 1. Growth and population projections for the affected area. 2. Location and characteristics of any disadvantaged unincorporated communities, 3. Present and planned capacity of public facilities and adequacy of public services, including infrastructure needs or deficiencies. 4. Financial ability of agencies to provide services. 5. Status of, and opportunities for, shared facilities. 6. Accountability for community service needs, including governmental structure and operational efficiencies. 7. Any other matter related to effective or efficient service delivery, as required by commission policy. As part of the SOI update, the Commission is required to consider the following four criteria and make appropriate determinations in relationship to each: 1. The present and planned land uses in the area, including agricultural and open-space lands. 2. The present and probable need for public facilities and services in the area. 3. The present capacity of public facilities and adequacy of public services that the agency provides or is authorized to provide. 4. The existence of any social or economic communities of interest in the area if the Commission determines that they are relevant to the agency. Environmental Determination The California Environmental Quality Act ("CEQA") requires that the Commission undertake and review an environmental analysis before granting approval of a project, as defined by CEQA. The MSRs are categorically exempt from the preparation of environmental documentation under a classification related to information gathering (Class 6 - Regulation section 15306), which states: "Class 6 consists of basic data collection, research, experimental management, and resource evaluation activities which do not result in a serious or major disturbance to an environmental resource. These may be strictly for information gathering purposes, or as part of a study leading to an action which a public agency has not yet approved, adopted, or funded." Indeed, these MS Rs collect data for the purpose of evaluating municipal services provided by the agencies. There are no land use changes or environmental impacts created by such studies. Furthermore, the MSRs qualify for a general exemption from environmental review based upon CEQA Regulation section 15061(b)(3), which states: "The activity is covered by the general rule that CEQA applies only to projects which have the potential for causing a significant effect on the environment. Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA." Additionally, the SOI updates qualify for the same general exemption from environmental review based upon CEQA Regulation section 15061(b)(3). 2 There is no possibility that these MSRs or SOI updates may have a significant effect on the environment because there is no land use changes associated with the documents. If the Commission approves and adopts the MSRs and SOI updates and determines that the projects are exempt from CEQA, staff will prepare a notice of exemption as required by CEQA Regulation section 15062. Descriptions: Broadview Water District encompasses 9,636 acres in western Fresno County about two miles southwest of the City of Firebaugh. The District does not provide any services since all of the land was annexed to the Westlands Water District. International Water District encompasses 74 1 acres in the central part of Fresno County, immediately east of the City of Clovis. The District provides irrigation water services to one family owned farm. Mid-Valley Water District encompasses 13,400 acres and is located in the northwestern part of Fresno County, just north of the City of San Joaquin and just west of the City of Kerman. The District is inactive but is investigating opportunities to recharge ground water supplies. Oro Loma Water District encompasses 1,258 acres and in northwestern Fresno County at the intersection of Althea and Russell Avenues. The District provides irrigation water services. Stinson Water District encompasses 11,194 acres in the southwestern part of Fresno County, immediately south of the City of San Joaquin. The District provides irrigation canal maintenance services. Widren Water District encompasses 835 acres located in the western part of Fresno County, approximately five miles west of the City of Firebaugh. The District provides a groundwater management plan. The District previously provided irrigation water service to parcels within their boundaries. On February 28, 2005, Westlands Water District (Westlands) purchased all but 40 acres of the District's lands and existing infrastructure, and subsequently annexed all of the District's lands into Westlands on March 16, 2005. The District at this time exists in an administrative capacity only and no longer provides any service. Westlands did not purchase the land currently owned by the "Broadview Ginning Company." The land involved is approximately 40 acres located in the NE ¼ of Section 11 of township 13S Range 13E (S/W of the intersection of Bullard and Newcombe Aves.). Growth and Population Projections The District is immediately east of the City of Clovis boundary and Sphere of Influence (SOI). The current land use is agricultural, consisting of one family-owned farm. Some or all of the District lands are under consideration by the City of Clovis for use as an industrial area which would include one or more industrial uses. The City's General Plan also identifies residential uses of varying intensities within/near to the District. It is unknown when a change of land use might take place, and to what population density the area may be developed. Location and Characteristics of any Disadvantaged Communities There are no disadvantaged communities within the district. Infrastructure Needs and Deficiencies The District does not have any infrastructure or facilities. The water that the District is able to acquire is conveyed through the single landowner's private facilities. There are no plans or need for future facility expansion. Financial Ability to Provide Services The District is financed by the family-owned fann, which pays for all expenditures the District incurs. Financial statements and budgets were not provided to LAFCo to determine the fiscal status, assess financial practices, and review pertinent management findings. The District has not filed budgets with the Fresno County Auditor-Controller's office, as required under Government Code Section 5390. The County does not follow-up with Districts that do not regularly file their budgets. Municipal Service Review International Water District 2 The State Controller's Office Special Districts Annual Report for Fiscal Year 2003-04 stated that enterprise operating revenues were $66,672 and enterprise non-operating revenues were $304. Status of, and Opportunities for, Shared Facilities The District exists solely to acquire irrigation water. No facilities are needed. There are no opportunities for shared facilities. Government Structure and Operational Efficiencies California Water Code section 34000-38500 enables the fonnation of Water Districts to provide a water services to lands within a district. The District currently provides irrigation water services. This District is an independent special district which has a separate board of directors not governed by other legislative bodies (e ither a city council or a county board of supervisors). The District appears to be able to function under its current government structure. It is not clear from the information provided that the property requires service from a Water District, and that the service could not continue to be provided by the landowner absent the District. There is no compelling public interest served by the District. The District currently serves one landowner, by acquiring irrigation water for the single farm. Farmers are able to acquire water rights without the need for a special district. Because of this, a special district may be unnecessary. The District does not have any employees. The family-owned farm provides for the District's needs as it arises. As the District lands become urbanized, the District may wish to work with the City of Clovis to develop a transition plan for converting a portion of the District's surface water rights to allow municipal and industrial uses. The District appears to be operated entirely by the private landowner. District staff is unsure about its ability to maintain a long-term water supply, due to environmental restrictions imposed by the Central Valley Improvement Act. The District is also investigating opportunities to recharge ground water supplies with surface water, to improve over drafted groundwater conditions. The District is working with the Mid-Valley Water Authority pursuant to Section 215 of the Reclamation Reform Act to try and use flood water for in-lieu recharge of groundwater. 2. Audited financial statements from Fiscal Year (FY) 2009-10 were reviewed by an independent auditor to detennine the fiscal status, assess financial practices, and review pertinent management findings of the District. The primary and sole source of financing for services for the past few years was from interest income. Municipal Service Review Mid-Valley Water District 2 In 2010, the District received $956 solely from interest income, the only source of revenue for the District. The District incurred operating expenses of $3,727, mainly for accounting, management, and audit expenses. The District is currently operating on a minimal budget of operating reserves, as no services are being provided at this time. The FY 2010 unrestricted assets were $184,534. A1mual budgets are projected to be approximately $7,500. The District has waived annual assessments on landowners within the District since the District has been unable to obtain and provide water to the landowners. Assessments were historically $3.00 per $100 of District land valuation, and were reduced to $1.00 per $100 of District land valuation, and have been waived annually since 2001. The 2012 adopted Budget included a total administration budget of $7,500, with $3,000 for accounting, $3,500 for general management and legal services, and $1,000 for contingencies. This distlict is an independent special district which has a separate board of directors not governed by other legislative bodies (e ither a city council or a county board of supervisors). The District does not have any employees and has contracted with a private consulting firm, Provost & Pritchard Consulting Group to provide services on an as needed basis. Provost & Pritchard Consulting Group was the first District Engineer and has been contracted by the District ever since. A body of five officials, elected to four-year terms, serves as the Board of Directors governing the District. Four board positions are currently vacant (one is in the process of being filled and the District is actively seeking another landowner to fill the third seat). Two of the Board member terms expire in 2013, and the other three terms expire in 2015. The Board creates policy by adopting resolutions or ordinances through duly noticed public hearings. The FY 2010 audited financial statements of the District indicated that current assets were $1,683, with no current liabilities. MUNICIPAL SERVICE REVIEW Description of District The Widren Water District is located in the western part of Fresno County, approximately five miles west of the City of Firebaugh. The District provided irrigation water service to a single landowner, whose property is comprised of 835 acres of farmland. Lands within District boundaries are mostly fallow and have been fallow for a period of time due to the impacts of subsurface drainage issues. A small portion of the District is irrigated with water produced by wells owned by the landowner. The District used to hold a water contract with the United States Bureau of Reclamation that provided water to the District's landowner. That water contract, the sole source of water for the District, was permanently assigned to Westlands Water District in 2003. The District no longer distributes water to land within its boundaries and does not anticipate ever acquiring a water supply. There is currently no demand for ini.gation water, as subsurface drainage issues have caused a high water table and the accumulation of salt and selenium, which resulted in the fallowing of most of the agricultural lands within the District. As noted above, what modest irrigation demands remain are satisfied from wells owned by the landowner, not by District water supplies. Widren Water District currently is operating to oversee a groundwater management plan under AB 3030 which allows certain defined existing local agencies, which includes the District, to develop a groundwater management plan. The current plan developed is a passive groundwater management plan. 2. MSR DETERMINATIONS This portion of the report addresses the factors specified in the governing statute for Municipal Service Reviews. Growth and Population Projections Most of the land within the District is currently fallow due to the impacts of subsurface drainage. According to the District, most of the lands within District boundaries are not anticipated to be farmed in the foreseeable future. Land uses within the District are anticipated to remain agricultural and are not expected to change to other land uses, although solar developers have expressed interest in the area for possible installation of solar generation facilities. Such facilities would not be served by the District. No growth or population increase is anticipated. Municipal Service Review Widren Water District 2 Location and Characteristics of any Disadvantaged Communities There are no disadvantaged unincorporated communities within the district. Infrastructure Needs and Deficiencies The District does not own any facilities and does not actively provide services. There is no demand or need for facilities. The District does not have any plans for any future facilities. Financial Ability to Provide Services Funding for this District is contributed by the single landowner that the District serves. Any funding required by the District is contributed by the landowner, on an as-needed basis. The District is able to impose assessments, standby charges, water charges, and similar fees. Cunently, the District does not charge any fees or assessments as the District is not providing service. The District does not have any outstanding debt. Status of, and Opportunities for, Shared Facilities The District is not providing and has no plans to provide service. The District does not own any facilities, and there are no opportunities for shared facilities. Government Structure and Operational Efficiencies California Water Code section 34000-38500 enables the formation of Water Districts to provide water services to a district. This District is an independent special district which has a separate board of directors not governed by other legislative bodies (e ither a city council or a county board of supervisors). The District does not have any employees and is still operational with the purpose of operating a groundwater management plan. A body of five officials elected serves as the Board of Directors governing the District, but one position is cunently vacant. Two of the cunent member's tenns expire in 2013, and the other two expire in 2015. The Board creates policy by adopting resolutions or ordinances through duly noticed public hearings. District meetings are held as required, since the District transacts very little business. Meetings are noticed and consistent with Brown Act requirements, which Municipal Service Review Widren Water District 3 include postings in public places. There appear to be ample opportunities for public involvement and input at meetings. 3. SPHERE OF INFLUENCE REVIEW AND UPDATE Govenunent Code Section 56076 defines Sphere of Influence as "A plan for the probable physical boundaries and service area of a local agency, as detennined by the commission. The Commission is required to review and update Spheres of Influence every five years, therefore, even though the District did not provide all of the requested infonnation, the Commission is obligated to update its Sphere. Description of Current Sphere of Influence The District's Sphere of Influence is cotenninous with its boundaries. Potential Proposed Sphere Changes No changes are proposed at this time. Sphere of Influence Recommendation and Determinations Inasmuch as no changes in the sphere of influence are proposed at this time, it is not necessary for the Commission to adopt or approve any sphere of influence update determinations. 4.
