Each of these districts is County-dependent, meaning the County of Monterey owns, operates, and administers these systems for the benefit of residents and business owners. County staff (Department of Public Works, Facilities, and Parks) provides system maintenance and administrative oversight. The County Board of Supervisors is the governing body for these districts. An additional County-dependent special district – the East Garrison Community Services District – is being addressed in a separate LAFCO study of all Community Services Districts countywide. The County also manages 11 closed landfills. The County refers to the closed landfills as a type of special districts within the County government structure. However, the closed landfills are not a special district for LAFCO purposes. This study meets LAFCO’s requirements, under state law, for conducting periodic service reviews and sphere of influence studies. The study is also intended to help inform the public about these districts and the status of current efforts and challenges. Key Findings The following key findings highlight the study’s main observations and conclusions. 1) The County Service Areas and Sanitation Districts are effectively delivering services and carrying out their purposes. The districts are professionally managed by full-time staff who are reliably delivering high-quality services to the community in a responsive, accountable, and legally compliant manner. The County’s Public Works, Facilities, and Parks Department provides various resources (depth of staff, institutional knowledge, technology, equipment) that would not necessarily be available to a smaller agency. Staff receives input from advisory committees for several of the CSAs. As the governing body of these districts, the County Board of Supervisors holds regular, noticed public meetings. Supervisors and their staff are available for discussions with district residents and business owners. 2) Securing adequate and sustainable sources of annual revenue is an essential priority for the districts. The County-administered districts are financially solvent, with positive fund balances. Current and future District expenditures are carefully planned as part of the budget cycle and capital improvement plans. District management is skilled and knowledgeable about utilizing the available funding levels to appropriately provide for infrastructure improvements and services. However, the County’s most recent (September 2023) Special Districts Annual Report found approximately two-thirds of the CSAs to be in fair or poor financial health, and raised the possibility of needing to cut some CSA services to be in line with available funds. County staff is well aware of the need to better align revenues with actual costs. The County’s September 2023 Annual Report identified priorities areas for proposed revenue enhancements. 1 A Sphere of Influence is defined by LAFCO of Monterey County as “A plan for the probable physical boundaries and service area of a local agency, as determined by LAFCO ([California Government Code] section 56076)… The area around a local agency eligible for annexation and extension of urban service within a twenty-year period.” LAFCO of Monterey County 4 3) No changes to the districts’ spheres of influence are recommended at this time. Most of the County-dependent districts covered in this report do not have an existing designated sphere of influence beyond their current boundaries. One CSA (#75, Chualar) and the Pajaro County Sanitation District each have a sphere of influence with approximately 12 parcels outside the district boundaries. District representatives have not sought any amendments to their spheres. Staff recommends that no sphere changes are currently warranted. Recommended LAFCO Actions Based on the facts and analysis in this study, the Executive Officer recommends adoption of a resolution to: 1. Find that, pursuant to Section 15306 of the California Environmental Quality Act (CEQA) Guidelines, the municipal service review and sphere of influence study is categorically exempt, in that the study consists of basic data collection, research, management, and resource evaluation activities that will not result in a serious or major disturbance to an environmental resource, and pursuant to Section 15061(b)(3), because it can be seen with certainty that there is no possibility that this study may have a significant effect on the environment; 2. Adopt the study’s recommended determinations (pages 14-15 of the study); and 3. Affirm the currently adopted spheres of influence of the 37 active County Service Areas, the Pajaro County Sanitation District, and the Boronda County Sanitation District, with no changes. In addition, LAFCO staff will continue to coordinate with and assist the County of Monterey regarding future reorganizations as the County’s needs and priorities evolve. Future potential requests by the County for LAFCO approvals may include, but are not limited to: • Detachment of San Jerardo from the Boronda County Sanitation District, after the BCSD water system is transferred to the San Jerardo housing cooperative, • Activation of a latent power for one or more CSAs, possibly including street maintenance services for CSA 1 (Carmel Point), • Dissolution of the inactive/defunct Carmel Valley Sanitation District, and • Potential annexations or out-of-agency service extensions for CSA 75 (Chualar), allowing parcels in the CSA’s existing sphere of influence, and/or other nearby parcels to connect to the CSA’s wastewater treatment system, which could become consolidated into the Monterey One Water regional system. 2025 MSR & Sphere Study County-Dependent Special Districts Page 5 Services Provided by the Districts • County Service Areas: CSAs are established to provide one or more enhanced municipal services within specific unincorporated areas. In a CSA, the County provides services that are not provided, or are not provided to same extent, in the unincorporated county as a whole. Property owners within the CSAs pay the additional cost of these services. In Monterey County, the 37 CSAs mostly provide storm drainage, street lighting, and maintenance of streets and sidewalks. CSA 50 provides levee maintenance and CSA 75 owns and operates Chualar’s wastewater treatment system. Areas within Monterey County CSAs range from 16 parcels (CSA 54) to over 1,000 parcels (CSA 72). CSA 74 (a funding mechanism for the countywide ambulance services contract) was addressed as part of LAFCO’s 2020 study of special districts that provide fire protection and emergency medical services, and is not within this study’s scope. In addition to the 37 active CSAs, there are two inactive CSAs in Monterey County. • CSA 69 (two noncontiguous subareas) • CSA 100 (six noncontiguous subareas) Each of the inactive CSAs functions as a backup funding mechanism for services (domestic water and wastewater) that are being adequately provided by private entities. The two inactive CSAs are further described within the table provided in Attachment 2 to this study. • Pajaro County Sanitation District (PCSD) provides sanitation (wastewater) collection in the communities of Pajaro, Las Lomas, Bay Farms, and part of Sunny Mesa. The collected wastewater is pumped to the City of Watsonville’s treatment plant. • Boronda County Sanitation District (BCSD) BCSD - San Jerardo subarea provides wastewater collection services in the ( Photo: Monterey County Weekly) Boronda community adjacent to Salinas. The collected wastewater is pumped to the Monterey One Water (M1W) regional wastewater treatment plant outside Marina. Since 2009, BCSD also provides water treatment and distribution of domestic/potable water to the small, 67-unit farmworker community of San Jerardo, about seven miles southeast of Salinas. The table below, prepared by County staff, shows the authorized powers (“A”) of the 37 active CSAs that provide municipal services in Monterey County. LAFCO staff has reviewed this table against an inventory of authorized CSA services that LAFCO prepared in 2009. The County’s table is consistent with LAFCO’s 2009 inventory. LAFCO of Monterey County 6 Potential Changes to Authorized Services Anytime a special district seeks to offer a service that the district is legally authorized to provide but is not currently providing, state law (the Cortese-Knox-Hertzberg Act) requires the district to apply for and 2025 MSR & Sphere Study County-Dependent Special Districts Page 7 obtain LAFCO approval (“activation of a latent power”). To date, the County has not requested any latent power activations for any of the CSAs or for Pajaro County Sanitation District. In January 2009, the Commission approved the County’s request to activate Boronda County Sanitation District’s latent power to provide potable water services. BCSD currently provides to this service to the small San Jerardo community, southeast of the City of Salinas. Currently, the County is actively engaged in transferring ownership of the water system to the San Jerardo housing cooperative. Following completion of the transfer, the County will likely apply for LAFCO approval to detach (“de-annex”) San Jerardo from the district, given that San Jerardo does not receive or require wastewater collection or other services from BCSD. During preparation of this study, County staff expressed interest in activating a latent power for CSA 1 (Carmel Point, with 233 parcels located just south of the City of Carmel-by-the-Sea). The CSA currently provides street lighting services within the CSA’s boundaries. County staff has indicated there may be a benefit to expanding the CSA’s services to include street maintenance. The planned future Scenic Road Protective Structure (SRPS) could be included under this service and paid for by CSA 1 residents. County staff is actively working on developing a scope of work for a potential grant opportunity to fund a geotechnical study to determine if the preferred project in the EIR is still feasible. Activation of CSA 1’s latent power to provide street maintenance services, along with any other potential changes to the authorized services of the other CSAs or the sanitation districts, will require a separate application process including a public hearing. State law does not empower LAFCO to approve a latent power activation as part of considering and adopting this study. District Formation, Boundaries, and Spheres of Influence Most of the CSAs were formed in the 1960s. The two sanitation districts were formed in 1946 (Pajaro) and 1983 (Boronda). All of these districts have remained relatively unchanging over time. The most recent change to any of the CSAs was in 2008, for a two-parcel annexation to CSA 52 (Carmel Valley Village storm drainage system). Between 2009 and 2012, LAFCO approved three small annexations to PCSD. Each of these annexations consisted of one to two parcels. In 2009, LAFCO approved a sphere amendment and annexation bringing the San Jerardo community into BCSD. This approval also included activation of BCSD’s latent power to provide potable water services, as discussed above. These actions were initiated by the County in response to an immediate public health crisis being posed by groundwater contamination impacting San Jerardo’s then-existing private wells. Only one County Service Area, CSA 75 (Chualar sanitation system) has a CSA 75 sphere of influence (anticipated future growth/expansion area) designated by LAFCO beyond the district boundary. In 1982, LAFCO designated approximately 12 parcels as the CSA’s sphere. To date, these parcels have not been annexed into the CSA. LAFCO of Monterey County 8 Pajaro County Sanitation District has a total of about 12 parcels, in the Pajaro and Las Lomas areas, within the district’s sphere of influence, as designated by LAFCO in 1983. PCSD (Pajaro PCSD (Las subarea) Lomas subarea) Boronda County Sanitation District has no designated sphere beyond the existing district boundary. County representatives have not identified or requested any sphere of influence amendments for the CSAs or the two sanitation districts. LAFCO staff concurs that no sphere changes are currently warranted. In the future, the County may request LAFCO approval of detachment of San Jerardo from BCSD, as discussed on the previous page. 2025 MSR & Sphere Study County-Dependent Special Districts Page 9 2023 Annual Report (by the County of Monterey) In September 2023, County staff completed a Special Districts Annual Report for Fiscal Year 2022-2023. The County’s report is Attachment 1 to this service review. The report covers the CSAs as well as the two sanitation districts. Some main points in the report include: • In the Finances and Financial Sustainability section, the report states that “To the extent feasible, it is the County’s goal to manage the CSAs toward long-term financial sustainability, where CSA revenues are sufficient to cover ongoing maintenance and long-term infrastructure replacement costs, so that there are no impacts to County General Fund. A CSA is considered financially sustainable when its annual revenue supports the costs of its annual maintenance and repairs while building reserves to fund capital projects.” The report discusses constraints on raising special districts revenues, and notes that “The special assessment amounts for nearly all CSAs have remained unchanged for many years, except CSA 75- Chualar (increase adopted in 2017), CSA 66-Oak Tree Views (increase adopted in 2019), and most recently, CSA 25-Carmel Valley Golf & Country Club (also known as Quail Lodge) which held a successful Proposition 218 election in July 2023.” The report finds that only 13 of the 37 CSAs are in “good” financial health, defined as “those CSAs that currently have high fund balances relative to annual expenses and can preserve or increase fund balances on an annual basis.” The remaining CSAs were judged to be in fair or poor financial health. • The Assessment Rate Setting section of the report states that “Based on the financial health grades listed in Exhibit 3 for each of the CSAs, about two-thirds of the CSAs will need engineer’s reports and a Prop. 218 election to set rates at a level that will provide sufficient funding to deliver the authorized services. If a proposed rate increase is not approved by property owners, the County would be limited to providing a reduced level of service commensurate with the available revenue, or providing only emergency repair services. In some cases, it may be necessary to consider discontinuing certain services to better align with the available revenue. • The Recent and Planned Activities section describes FY 22-23 maintenance projects, emergency projects necessitated by flooding that occurred in January and March 2023, projects made possible by American Rescue Plan Act (ARPA) federal funds, and the County’s priority areas for seeking to update annual assessments by obtaining engineer’s reports and implementing Proposition 218 elections. County staff does not anticipate preparing an annual report for FY 2023-24. Staff resources are needed for emergency projects related to the 2023 floods, as well as ARPA-funded projects. Financial Summary The County’s September 2023 Annual Report – outlined above and attached to this study – provided summary-level financial information for the CSAs through June 30, 2023. The updated table below reflects the County’s most recent data and includes the two sanitation districts. As shown in the second- to-last row above, County staff estimates that BCSD will exhaust nearly its entire fund balance by the end of the current fiscal year. In describing the reasons for this circumstance, County staff explained that BCSD’s atypically high expenses in FY 2024-25 have included a rate study ($71,000), the sewer system management plan (approximately $20,000), sewer line cleaning ($45,000), a sewer spill, and much higher- than-usual staff time related to these items. County staff anticipates a Proposition 218 vote process upon completion of the rate study in the very near future. If the Proposition 218 process succeeds, new (higher) rates will be in place for FY 2026-27. In the interim, the recently cleaned sewer lines will greatly diminish the risk of sewage spills in FY 2025-26. County staff is also trying to reduce staff time expenses through the remainder of FY 2024-25 to preserve some of the remaining current fund balance. County-Owned Sanitation Systems: Ongoing Repairs and Potential Future Sale or Transfer For the last approximately 20 years, the County has been seeking to divest itself from sanitation systems. Around 2005, the County sold the Carmel Valley Sanitation District system to investor-owned utility Cal Am. The Moss Landing County Sanitation District consolidated into the Castroville Community Services District in 2014. The County continues to seek to sell or transfer the Boronda and Pajaro County Sanitation Districts, as well as CSA 75 (Chualar wastewater system). In July 2023, County Public Works staff prepared a status report on the potential sale/transfer of these three remaining County-owned sanitation systems. The status report later became an attachment to the County’s Special Districts Annual Report, discussed immediately above. In 2022, the County issued a Request for Qualifications regarding transfer of all three systems. The County received one qualifications package in response. The County Board directed staff to reject the response. The report stated, in part: “To summarize, there are currently no suitors for the PCSD or BCSD.” The July 2023 status report also discussed that, pursuant to Board of Supervisors direction, County staff is continuing to work with state regulators to pursue consolidating A holding pond in the wastewater treatment system CSA 75 (Chualar) into the regional in Chualar, as seen in 2014 (Photo: MC Weekly) wastewater treatment system. On February 10, 2025, a staff report to the County’s Capital Improvement Committee indicated that an “Application to State Water Board for grant to support potential consolidation of Chualar system (i.e., eliminate wastewater ponds treatment component and connect to existing regional wastewater treatment system) has been submitted and State review is in progress. A decision by State Water Board regarding […] funding is expected shortly.” In March 2025, the County issued a Request for Proposals seeking an engineering firm to guide the consolidation project described above. The County’s RFP states that: • “The objective of this project is to evaluate options for the Chualar Wastewater Treatment Plant; repair/upgrade the existing Chualar Wastewater Treatment Plant, construct a new wastewater treatment plant, and connect the Chualar wastewater collection system with the City of Salinas collection system for treatment at the Monterey One Water Regional Treatment and Recycling Facility. The Project will also evaluate options for connecting additional parcels outside of the existing Chualar wastewater collection system” (emphasis added; the additional parcels would likely include those within the District’s existing designated sphere of influence). Proposals are due by April 25, 2025. LAFCO of Monterey County 12 The July 2023 report also described recent Press conference announcing a $4,075,000 grant to and in-progress repairs and upgrades to the PCSD and BCSD systems. Flooding on fund PCSD repairs (Photo: Santa Cruz Sentinel) the Pajaro River in 2023 resulted in devastating impacts to the community of Pajaro, including residents and businesses being displaced for weeks, the closure of Pajaro Missile School for 17 months, and damage to infrastructure systems. In January 2025, the County of Monterey received a $4.1 million dollar U.S. Department of Agriculture grant for repairing PCSD systems such as lift stations, generators, sewer lines, and making them more resilient to future extreme flooding events. Additionally, the July 2023 status report addressed the County’s ongoing process of transferring ownership of the San Jerardo Water System (BCSD “Zone 2”) to the San Jerardo Housing Cooperative. LAFCO and County staff members are in coordination on formally detaching San Jerardo from BCSD as a companion action to transferring the water system. Disadvantaged Unincorporated Communities (DUCs) LAFCOs are required to identify disadvantaged unincorporated communities as part of this service review. Under state law, a DUC is defined as any area with 12 or more registered voters, or as determined by commission policy, where the median household income is less than 80 percent of the statewide annual median. In 2023, the median household income in California was $95,521, according to the U.S. Census Bureau. Eighty percent of this dollar amount is $76,417. The California Department of Water Resources has developed an online mapping tool to assist in determining which communities meet the definition of a DUC. The state’s map uses 2020 data (the most recent year for which complete data is available). Based on a review of the available maps and data, the areas that appear to meet the definition of a DUC for the districts within this study are: • Pajaro: portions of the community east of Salinas Road (PCSD) • Boronda (BCSD) • Chualar (CSA 75) • Arroyo Seco (CSA 53) 2025 MSR & Sphere Study County-Dependent Special Districts Page 13 Determinations Municipal Service Review Determinations , Per Government Code Section 56430(a) This section contains recommended Municipal Services determinations for the 37 active County Service Areas, Pajaro County Sanitation District, and Boronda County Sanitation District. 1. Growth and population projections for the affected area No significant population growth is currently projected for the unincorporated areas within these districts. Most of the land within these districts consists of residential areas that were subdivided and developed, consistent with their County land use designations, in previous decades. 2. Location and characteristics of any disadvantaged unincorporated communities (DUCs) within or contiguous to the sphere of influence State law defines DUCs as communities with an annual median household income of less than 80% of the statewide annual median household income. Census data indicate that residential areas within Pajaro, Boronda, Chualar, and Arroyo Seco (PCSD, BCSD, and CSAs 75 and 53 existing boundaries and spheres of influence) all have incomes below 80% of the statewide median income, meeting the definition of DUCs. These communities are predominantly or largely Spanish-speaking, with many of whose residents working in agricultural production. Inhabited parcels in these areas are generally already within the boundaries of the CSAs and the sanitation districts; therefore, the districts’ services are available to these residents. 3. Present and planned capacity of public facilities, adequacy of public services, and infrastructure needs and deficiencies (including needs or deficiencies related to sewers, municipal and industrial water, and structural fire protection in any DUCs within, or contiguous to, the sphere of influence) The CSAs operate limited public infrastructure, the majority of which pertains to storm drainage and street lighting. A notable exception is CSA 75, which owns and operates a small wastewater collection and treatment system. This system uses outdated technology and is susceptible to flooding during heavy rainfall, as occurred in January and March of 2023. The County is actively pursuing consolidating this system into Monterey One Water’s regional wastewater treatment system, as discussed in the study, which would alleviate this operational concern. The Pajaro and Boronda County Sanitation Districts collect wastewater which is then pumped to wastewater treatment plants operated by other agencies (City of Watsonville and Monterey One Water, respectively). BCSD also currently operates a domestic/potable water system for the small community of San Jerardo but is actively working on transferring ownership to the housing cooperative. There are no identified DUCs within or contiguous to the districts’ spheres of influence that are unserved or underserved with regard to water or wastewater services. 4. Financial ability of agencies to provide services The districts in this study have the benefit of professional administrative and financial oversight. However, the districts operate under significant financial constraints as discussed in this study and in the most recent Annual Report prepared by the County of Monterey. 5. Status of, and Opportunities for, Shared Facilities These districts operate as an extension of the County government structure. District staff are County employees who work out of County facilities and have access to a full range of County equipment, technology, and similar resources. 6. Accountability for community service needs, including government structure and operational efficiencies The County operates the studied special districts in compliance with applicable state law for special districts, with no areas of non-compliance identified. Any Other Matter Related to Effective or Efficient Service Delivery, As Required by Commission Policy LAFCO staff reviewed locally adopted LAFCO policies and noted no additional matters. Sphere of Influence Determinations, Per Government Code Section 56425(e) This section provides recommended sphere of influence determinations for the special districts analyzed in this study. 1. Present and planned land uses in the area, including agricultural and open-space lands Lands within these districts are primarily residential and developed. No impacts to agricultural or open- space lands, are likely to occur in relation to the districts. 2. Present and probable need for public facilities and services in the area There is a demonstrated need for continuity of the facilities and services that are currently provided by the districts in this study. However, in the future it is also possible that another qualified public or private entity could take on the responsibility of owning and operating one or more of these systems. Over the long term, the County is gradually divesting itself of sanitation systems, but has not yet reached an agreement with a qualified successor entity to acquire the Pajaro or Boronda sanitation collection system. 3. Present capacity of public facilities and adequacy of public services that the agency provides or is authorized to provide The facilities and infrastructure owned and operated by these districts are generally functional and providing services in response to current needs. However, there are continual, ongoing requirements for upgrades and improvements, some of which would go beyond current financial resources as discussed in the study and in the County’s September 2023 Annual Report. 4. The existence of any social or economic communities of interest in the area, if the commission determines that they are relevant to the agency As discussed under MSR determinations #2 and #3, areas within the current boundaries and spheres of influence of some of the districts in this study appear to meet the definition of Disadvantaged Unincorporated Communities (DUCs) as defined in Government Code. These areas currently have access to district services, and there are no proposed or recommended changes to the existing services or boundaries. 5. For an update of a sphere of influence of a city or special district that provides public facilities or services related to sewers, municipal and industrial water, or structural fire protection, the present and probable need for those public facilities and services of any DUCs within the existing sphere of influence. The County utilizes its staff and Capital Improvement Committee to identify needs for significant capital reinvestment and construct infrastructure improvements, to the extent possible given limited funding levels. The County is also interested in selling or transferring its three remaining sanitation systems (Pajaro, Boronda, and CSA 75 in Chualar). Areas that appear to qualify as Disadvantaged Unincorporated Communities (DUCs) within the studied districts receive district services. SUMMARY/DISCUSSION: The County of Monterey has used a variety of special districts for nearly 60 years to provide services to County residents including 37 active County Service Areas (CSA), two County Sanitation Districts (CSD), 11 Closed Landfills, and most recently, one Community Services District. These special districts are formed through the Monterey County Local Agency Formation Commission (LAFCO) to provide one or more services that the County does not provide to the same extent countywide, and where it is intended that property owners or ratepayers within the boundaries of those special districts pay for the authorized services to be provided. Any change to services and/or boundaries requires an amendment approved by LAFCO. A CSA is an alternate method for providing governmental services by counties in unincorporated areas, where the community within the boundary of an established CSA pays for one or more services such as road maintenance, street lighting, storm drainage maintenance, etc. The CSAs within Monterey County are administered by the PWFP Department under the direction of the County Board of Supervisors, which is the governing body for the CSAs. CSDs were established to provide sanitation (sewer) services. The Pajaro County Sanitation District (PCSD) provides for sanitation collection in the communities of Pajaro, Las Lomas, Bay Farms, and a portion of Sunny Mesa. The Boronda County Sanitation District (BCSD) provides for sanitation collection services in the Boronda community and for water treatment and distribution in the San Jerardo community. In 2006, the East Garrison Community Services District was formed to provide for neighborhood parks and open space maintenance, storm drain and flood control system maintenance, and perimeter County roads maintenance. Management and administration were provided by the Resources Management Agency until dissolution of that agency in late 2020, and is now handled by the Special Districts Unit of the Public Works, Facilities and Parks Department (PWFP). This unit has four full time staff positions to manage these operation and maintenance activities, and a fifth full time position in PWFP is primarily assigned to support management of the East Garrison Community Services District. Additional support is also provided by the PWFP Bridge Maintenance crew, which acts as the sanitation crew for the County Sanitation Districts. Finally, staff uses the services of various consultants and contractors to help provide services to the various special districts. This report provides information about the services provided to the special districts, summarizes financial positions, and discusses recent and planned key activities. COUNTY SERVICE AREAS Background There are 37 active County Service Areas (CSAs) within the County. A CSA is an alternate method for providing governmental services by counties in unincorporated areas, where the community within the boundary of an established CSA pays for one or more services such as road maintenance, street lighting, storm drainage maintenance, etc. The CSAs within Monterey County are administered by the PWFP Department under the direction of the County Board of Supervisors, which is the governing body for the CSAs. CSA law was established in 1953 to allow counties to provide a wider variety of services in unincorporated areas where residents are willing to pay for the extra service. Updated CSA law took effect in 2009 and more clearly defined CSAs’ policies, powers, procedures, and clarified the oversight role of the Local Agency Formation Commission (LAFCO). CSAs can provide one or more of the services allowed by law, provided those are authorized by the LAFCO. In Monterey County, it is the Monterey County LAFCO that approves formation of a CSA and the specific service(s) it is authorized to provide. The first CSA in the County was formed in 1959, and the most recent was formed in 1993. Current CSAs and Services The most common service provided to the CSAs is for storm drain maintenance/surface water management, followed by street lighting. Eight CSAs receive street and sidewalk maintenance services, four receive park/open space management services, one receives levee maintenance services, and one receives sanitary sewer collection and treatment services. Exhibit 1 lists all 37 CSAs along with the authorized services provided for each. The size of County CSAs varies from 16 to over 1,000 parcels. Most CSAs consist of one contiguous area, although due to annexation, there are also CSAs with noncontiguous parcels located some distance from each other. Location maps for all CSAs within the County are provided in Exhibit 2. To facilitate community communication and engagement, advisory committees have been created for six CSAs: CSA 1-Carmel Point; CSA 15-Serra Village; CSA 25-Carmel Valley Golf & Country Club; CSA 45-Oak Hills; CSA 47-Carmel Views/Mar Vista; and CSA 50-Rioway Tract No. 2. Regular meetings are held in accordance with the Board of Supervisors resolutions which formed the Advisory Committees. Finances and Financial Sustainability To the extent feasible, it is the County’s goal to manage the CSAs toward long-term financial sustainability, where CSA revenues are sufficient to cover ongoing maintenance and long-term infrastructure replacement costs, so that there are no impacts to County General Fund. A CSA is considered financially sustainable when its annual revenue supports the costs of its annual maintenance and repairs while building reserves to fund capital projects. CSAs receive revenue from various funding sources: 1) Property Tax Allocation; 2) Special Assessments; 3) Interest Income; and 4) Homeowners Property Tax Relief. The largest source of CSA funding is from general property tax allocation, commonly referred to as “AB 8 funding,” after State Assembly Bill 8, California Property Tax Apportionment. In 1979, AB 8 was adopted and outlined an allocation procedure for the countywide one percent (1%) property tax. An established percent of general property tax is allocated to the specific CSA in which the property is located based on a complex formula. Currently, 33 of the 37 CSAs receive AB 8 funding. As property valuations increase when property is sold or transferred, AB 8 revenue also increases. The second largest funding source is special assessments that were typically established at the time of creation to fund authorized services within the specific CSA. Currently, 31 of the 37 CSAs receive funding from separate assessments collected on their property tax bills. The special assessment amounts for nearly all CSAs have remained unchanged for many years, except CSA 75-Chualar (increase adopted in 2017), CSA 66-Oak Tree Views (increase adopted in 2019), and most recently, CSA 25-Carmel Valley Golf & Country Club (also known as Quail Lodge) which held a successful Proposition 218 election in July 2023. A third source of CSA funding is interest on fund balances. Generally, this yields a very low percentage of revenue. Finally, a very small revenue stream results from Homeowners’ Property Tax Relief. This source provides less than one percent of CSA revenue. Individual CSA fund balances range from less than $500 to approximately $3.3 million. However, fund balances are not solely indicative of the overall financial sustainability of each CSA. For example, a CSA whose only authorized service is streetlighting is not required to maintain the same level of reserves as a CSA with a storm drainage system or road network. The current management strategy for CSAs is to preserve existing fund balances to the extent feasible to address emergency repairs until a CSA-specific engineering report and corresponding rate adjustment(s) may be considered by the Board of Supervisors as discussed below. To evaluate financial sustainability or “financial health” of each CSA, staff qualitatively assess each CSA to assign a financial sustainability “health grade” based on a CSA’s ability to fund its annual maintenance and repair expenditures with annual revenue combined with the level of fund balance. A good sustainability grade is assigned to those CSAs that currently have high fund balances relative to annual expenses and can preserve or increase fund balance levels on an annual basis. A fair sustainability grade is assigned to those CSAs that have been able to fund annual maintenance and repair costs with annual revenue but have low fund balances or a reduced fund balance due to emergency repairs. A poor sustainability grade is assigned to CSAs that have insufficient revenue to fund annual expenses; depleted or severely reduced the fund balance due to annual maintenance costs that exceed annual revenue or emergency repairs; or have required General Fund assistance to pay for emergency repairs. Exhibit 3 provides the current funding status and financial health grade for each CSA, which is used by staff to develop, prioritize, and schedule CSA-specific analyses to justify proposed assessment rate increases to improve the CSA’s financial sustainability. CSA Analysis CSA law established procedures and requirements for imposing assessments that are further defined in Section 4 of Article XIIID of the California Constitution. Engineers’ reports are required to estimate the amount of special benefits that property owners will receive from a project or service. To determine the special benefits, this report may also include, but not be limited to the condition of existing infrastructure; costs for maintenance; costs for recommended or required repairs, upgrades, and potential capital improvements. This data is used to determine service levels and the appropriate assessment rates necessary to fund these services. Assessment Rate Setting In November 1996, California voters passed Proposition 218 (Prop. 218), the “Right to Vote on Taxes Act.” This constitutional amendment protects taxpayers by limiting the methods by which local governments can create or increase taxes, fees, and charges without taxpayer consent. Based on the financial health grades listed in Exhibit 3 for each of the CSAs, about two-thirds of the CSAs will need engineer’s reports and a Prop. 218 election to set rates at a level that will provide sufficient funding to deliver the authorized services. If a proposed rate increase is not approved by property owners, the County would be limited to providing a reduced level of service commensurate with the available revenue, or providing only emergency repair services. In some cases, it may be necessary to consider discontinuing certain services to better align with the available revenue. Recent and Planned Activities Over the past fiscal year, staff has been focused on improving service delivery to the CSAs and striving to address ongoing maintenance needs given staffing challenges and CSA funding challenges. An Engineer’s Report has also been prepared for CSA 17 Tierra Grande, one of the few CSAs that does not have an established annual assessment. It is estimated that the process can be finalized by March 2024 and, if successful, assessments will be placed on the 2024-25 tax rolls. Once completed, staff recommends implementing the Proposition 218 process to improve long-term financial stability for CSA 9-Oak Park, CSA 15 Toro Park/Serra Village, CSA 24-Rancho Rio Vista, and CSA 75-Chualar. A sewer rate increase for CSA 75 was passed in March 2017. Industry standards dictate that utility rates be reviewed at least every five years to ensure that rates accurately reflect the cost of operating the system in a self- sufficient manner. COUNTY SANITATION AND WATER DISTRICTS Background The County Sanitation Districts were formed under the County Sanitation District Act, pursuant to California Health and Safety Code Section 4700. CSDs are separate legal entities of local government operated under the direction of the Board of Supervisors. Currently, the County manages two County Sanitation Districts: the Pajaro County Sanitation District (PCSD) and the Boronda County Sanitation District (BCSD). The PCSD provides for sanitation collection in the communities of Pajaro, Las Lomas, Bay Farms, and a portion of Sunny Mesa. Wastewater is collected and pumped to the City of Watsonville Treatment Plant for treatment. The BCSD provides for sanitation collection in the community of Boronda. Wastewater is collected and pumped to the Monterey One Water treatment plant via City of Salinas sanitary sewer collection lines. The San Jerardo Housing Cooperative, Inc., (sometimes referred to as, “Cooperative”) community was annexed into the BCSD as Zone 2-San Jerardo in 2011 to provide potable water service to the Community. Disposition of County Sanitation and Water Systems It is the goal of the County to divest all interests in CSA and County Sanitation District (CSD) sanitation and water systems, including sanitation systems owned by CSA 75-Chualar, PCSD, BCSD, and BCSD-Zone 2 (San Jerardo Water System), excluding County Parks sanitation and water systems. Staff has been working to fulfill the Board of Supervisors’ goal of transferring the San Jerardo Water System and selling the three sanitation systems. Staff’s primary focus of late has been in addressing deferred maintenance needs by implementing many water and sewer infrastructure repair projects using a portion of the County’s American Rescue Plan Act (ARPA) fund allocation. Progress toward disposition of the County’s sanitation and water systems is reported quarterly to the Board of Supervisors’ Capital Improvement Committee and Budget Committee. The latest progress report is provided in Exhibit 4. CLOSED LANDFILLS The County currently manages 11 closed landfills which are regulated by the Federal Environmental Protection Agency (EPA) and the State of California Water Resources Control Board (Water Board). The Monterey County Health Department (Health Department) is the Local Enforcement Agency. State and Federal laws mandate post-closure monitoring and reporting activities including, but not limited to, annual water-quality monitoring, preparation, and implementation of Stormwater Pollution Prevention Plans (SWPPPs), wet weather monitoring well inspections and reports, biannual dry weather inspections, and stormwater collection and analysis. Per State regulations, the County was conducting formal monitoring and reporting for three of the County-owned closed landfills (Lake San Antonio-North Shore, San Ardo, and Bradley). However, that requirement has been fulfilled and is no longer needed. The closed landfill sites still require ongoing permits and as-needed inspections to ensure that appropriate Best Management Practices (BMPS) are implemented to minimize or prevent stormwater pollution. Expenses related to closed landfills are funded by the General Fund 001, and there is minimal annual lease revenue in the amount of $425 for the use of the Chualar closed landfill. The estimated FY 2022-23 year-end expenditure is $117,144 and the proposed FY 2023-24 budget is $149,359. COMMUNITY SERVICES DISTRICTS The County manages a Community Services District known as the East Garrison Community District (EGCSD). The EGCSD was created in 2006 to provide park and open space maintenance, storm drain and flood control system maintenance, and perimeter road maintenance services for the East Garrison Community located along Reservation Road east of the City of Marina. The EGCSD is a dependent Community Services District where the Monterey County Board of Supervisors serves as the Board of Directors for the EGCSD. An Advisory Committee was established in 2018, consisting of five members and three alternates appointed by the Monterey County Board of Supervisors, acting as the Board of Directors of the EGCSD. Per a request by the EGCSD Board of Directors and approval by the Board of Supervisors, an election was held on November 8, 2022 for registered voters in the East Garrison community to consider whether to become and independent district and elect an independent Board of Directors. The result of the election was that a majority of voters did not support an independent district. Therefore, the County continues to provide administration and governance of the EGCSD. Currently, the EGCSD is supported by special taxes levied and collected by the East Garrison Public Financing Authority (EGPFA). Annual budgets for the EGPFA and EGCSD are included in the County’s Annual Budget document. The EGCSD can recommend again in the future that an election be conducted to determine if residents would like to consider becoming an independent district. In the future, the County may seek LAFCO approval to activate this CSA’s latent power to provide street maintenance services, which would provide funding for the planned future Scenic Road Protective Structure project. 9 Oak Park This CSA was formed on October 2, 1961 to provide street lighting and stormwater management services to Oak Park and nearby annexation areas. The CSA is approximately 68 acres in size with non-contiguous service areas both north and south of the City of Salinas. 15 Serra Village & Toro Park This CSA was formed on December 10, 1962 to provide street lighting, stormwater management, and parkway facilities and services to Toro Park and Serra Village. 17 Rancho Tierra Grande This CSA was formed on January 21, 1963 to provide for off- site drainage from the Tierra Grande subdivision to the Carmel River and to provide open space maintenance in the public areas. There are approximately 230 single-family residential lots in the CSA, with a population of approximately 400 persons. 19 Carmel Meadows CSA 19 was formed in 1961. The district encompasses an area of approximately .05 square miles (32 acres). The total population is approximately 70. 20 Royal Estates This CSA was created by County Resolution #63-102 in May of 1963 to serve 140 parcels within the 46-acre Royal Estates Subdivision. The CSA is located at the intersection of Pine Canyon Road and Jolon Road, approximately 1 mile southwest of King City. Services provided including streetlights and storm water drainage. 23 Carmel Rancho CSA 23 was formed in 1963. The district encompasses an area of approximately .25 square miles (165 acres). The total population is approximately 400. 24 Pedrazzi Subdivision/ This CSA was formed on November 18, 1963 to provide Indian Springs stormwater management services. to the Pedrazzi Subdivision 2, Indian Springs Ranch, Heritage Park, Vista 1 Del Rio and Pine Canyon Estates Subdivisions. The CSA is approximately 405 acres in size. 25 Carmel Valley Golf and This CSA was formed on November 26, 1963 to provide Country Club street and sidewalk, storm drain, and road shoulder maintenance for the Valley Greens subdivision and golf course. The area consists of a golf course, 165 single-family residential lots, and 21 condominium lots, serving approximately 400 people. 26 New Moss Landing This CSA was formed in 1964 to provide street lighting for Heights the New Moss Landing subdivision. Lighting is provided through a contractual agreement with Pacific Gas and Electric Company who owns and maintains all the street lighting facilities. This 62-lot subdivision is located off Potrero Road at the southern edge of Moss Landing. 30 Rancho Mar Monte CSA 30 was formed in 1964. The district encompasses an area of approximately .5 square miles (65 acres). The total population is approximately 60. 31 Aromas Hills Subdivision This CSA was formed in 1964 to maintain storm drainage facilities for two non-contiguous subdivisions within the village of Aromas. One subdivision consists of 22 single- family residential parcels on a cul-de-sac that extends from Carpenteria Road. The other subdivision contains 10 single- family residential lots on Blohm Avenue and a large remainder lot. 32 Green Valley Acres and This CSA was formed in 1964 to provide street lighting and Moon Subdivisions maintenance of storm drainage facilities for three non- contiguous subdivisions in the Prunedale area. Street lighting is provided through a contractual agreement with Pacific Gas and Electric Company who owns and maintains all the street lighting facilities. Storm sewers and their associated facilities are maintained by the County Public Works Department. 33 Coast Ridge Subdivision CSA 33 was formed in 1963. The district encompasses an and Carmel Sur area of approximately 45 square miles (285 acres). The total population is approximately 500. 34 Rancho Rio Vista and This CSA was formed on December 14, 1961 to provide Carmel Knolls storm drain facilities and street lighting. There are over 260 single-family residential units in the CSA, with a population of approximately 600 persons. Street lighting is provided through a contractual agreement with Pacific Gas and Electric Company who owns and maintains all the street lighting facilities. The County Public Works Department maintains the storm drains and related facilities. 2 35 Paradise Park and Rancho This CSA was formed in 1965 to provide street lighting and Borromeo maintenance of storm drainage facilities for two non- contiguous subdivisions in the Prunedale area. Street lighting is provided through a contractual agreement with Pacific Gas and Electric Company who owns and maintains all the street lighting facilities. Storm sewers and their associated facilities are maintained by the County Public Works Department. 37 Colonial Oaks Estates This CSA was formed in 1965 to provide the residents within the Colonial Oaks Estates subdivision with storm drainage maintenance. 38 Paradise Lake Estates This CSA was formed in 1965 to provide storm drainage maintenance for 64 parcels. 41 Gabilan Acres and Boronda This CSA was formed on December 14, 1965 to provide street lighting services. The CSA is approximately 100 acres in size and contains a service population of approximately 2,100 persons. 44 Corral de Tierra Oaks 1, 2 CSA 44 was formed in 1966. The district encompasses an and 3 area of approximately 65.657 acres. The total population is approximately 300. 45 Oak Hills Subdivision This CSA was formed in 1966 to provide street lighting, storm drainage maintenance, and management of common open space. Street lighting is provided through a contractual agreement with Pacific Gas and Electric Company who owns and maintains the street light facilities in the area. Storm sewer facilities and open space are maintained by the County Public Works Department. 47 Carmel Views and Mar This CSA was formed on November 9, 1966 to provide Vista drainage facilities to the Carmel Views and Mar Vista subdivisions. The CSA contains approximately 172 single- family residential lots, with a population of about 300. 50 Rioway Tract No. 2 This CSA was formed on November 14, 1967 to provide (Lower Carmel River) storm drain facilities to the Mission Fields area west of Highway 1 at the mouth of the Valley. In 1995 the Sphere of Influence of the CSA was expanded to include the commercial and residential areas east of Highway 1 and add flood control service capability. This action was a direct result of the Carmel River flooding that occurred that year and to respond to the needs of the community. In 1996 the District was expanded to its present configuration. The CSA contains the Carmel Crossroads, Carmel Center, and various other commercial and office properties. It also 3 includes approximately 600 residential lots, with a population of about 1,000. In 1995, under an emergency order, the levee protecting properties along the Carmel River was repaired and raised. In 1996 the District participated with other agencies in taking down the Odello levee on the south side of the River, using grant funds and Public Works labor. The levee was notched in four locations to allow water to flow through. In 1997 the tie-back levee at Rio Road was completed and the fourth notch of the Odello levee was protected. Additional improvements in this period included widening and lowering the notches on the Odello East levee, raising the tie-back levee, installing floodwall, making levee improvements, and adding pump stations. In 2021, the County Board of Supervisors approved the Carmel River Floodplain Restoration and Environmental Enhancement (CRFREE) project. The project includes partial removal of existing levees along the river channel and construction of a causeway along a portion of Highway 1 to facilitate movement of floodwaters out of the area. Project construction has not yet begun. After the project has been built, there are several drainage improvements and perimeter flood protection projects that will be needed to remove CSA 50 from the FEMA-defined 100-year floodplain. The projects were identified in the CSA 50 Final Lower Carmel River Stormwater Management and Flood Control Report dated October 2014. Since the report was prepared, CSA 50 has committed to paying for mowing necessary to maintain the CRFREE project. As of April 2025, County staff anticipates that the CSA will likely need to complete an engineer’s report and a Proposition 218 vote process to ensure adequate revenue will be generated to pay for the CSA’s current commitments and the drainage/perimeter flood protection projects needed to remove the area from the 100-year floodplain. 51 High Meadows This CSA was formed on November 14, 1967 to provide street lighting and storm drain maintenance. It serves approximately 220 residential units. The County Public Works Department provides the maintenance of the storm and surface water facilities, and PG&E provides street lighting under contract. 52 Carmel Valley Village This CSA was formed on November 12, 1967 to provide storm drain facilities to various non-contiguous areas located in the Carmel Valley Village area. The multiple separated areas were included in the CSA as a result of subdivisions or property owner desires to participate in the services. Approximately 200 persons are served. 4 53 Arroyo Seco This CSA was created in December 1968 to serve 4,346 acres northwest of Greenfield. This CSA provides storm water disposal services to 31 parcels. 54 Manzanita and Sarsi This CSA was formed in 1969 to maintain storm drainage Subdivisions facilities for two adjoining subdivisions located off Sill Road in the community of Las Lomas. There are 18 residential lots served by the CSA. 55 Robles del Rio Carmel This CSA was formed on September 2, 1969 to provide Subdivision storm drain and surface water disposal facilities to the Robles del Rio and Carmel subdivision. The CSA contains 67 lots with a population of approximately 200. It is located south of the Carmel Valley Village area off Esquiline Road. 56 Del Mesa Carmel This CSA was formed June 23, 1970 to provide drainage facilities and an emergency fire road to Del Mesa Carmel. It contains 289 lots with approximately 420 residents. The County Public Works Department maintains a pond at Carmel Valley Road, provides for the off-site drainage from Carmel Valley Road to the Carmel River, and maintains an emergency fire road. 57 Los Tulares Subdivision This CSA was formed June 23, 1970 to provide storm drain facilities. The CSA contains 76 residential lots with a population of approximately 150. 58 Vista Dorado CSA 58 was formed in 1970. The district encompasses an area of approximately 19 acres. The total population is approximately 50. 62 Rancho Del Monte No. 14 This CSA was formed December 2, 1972 to provide storm drain facilities for 29 residential lots. It has a population of approximately 70. 66 Oak Tree Views This CSA was formed in 1966 provide storm drainage maintenance services for 1) a small area of Las Lomas in northern Monterey County, and 2) the Monterra Ranch subdivision, which is located near the Monterey Airport. The residents within the Las Lomas portion of the CSA have voted to cease maintenance of storm drainage needs and to terminated assessing themselves through the CSA. As a result, there are currently no services provided to the Las Lomas portion of the CSA. 67 Corral de Tierra Oaks #4 CSA 67 was formed in 1977. The district encompasses an area of approximately 163 acres with a population of about 60. 68 Vierra Canyon Knolls This CSA was formed in 1978 to provide storm sewer facilities and maintenance for three non-contiguous 5 subdivisions in the Prunedale area: A 22-lot subdivision off the western segment of Vierra Canyon Road, a 12-lot subdivision on a cul-de-sac extending from the eastern segment of Vierra Canyon Road, and a 44-lot subdivision off Berta Canyon Road. 69 Ralph Lane and Monterra This CSA was formed in 1982 as a backup funding source to Ranch (Backup Funding) provide domestic water for: 1) 23 residential lots on Ralph INACTIVE Lane in Prunedale, and 2) the Monterra Ranch area. The water system was sold in 2002 to the California American Water Company, which now operates the system. The County will therefore not continue active participation in the CSA unless funding or management problems occur. 72 Las Palmas Ranch CSA 72 was formed in 1984. The district encompasses an area of approximately 1,434 acres. The total population is approximately 3,400. 75 Chualar Consolidated This CSA was formed on September 21, 1993 through the consolidation of the Chualar County Water District, the Chualar County Sanitation District, and the Chualar Lighting District. This CSA is unique in that it provides a broader array of services to a more diverse service base that includes both residential and commercial users. The CSA provides street lighting, stormwater management, and wastewater disposal services. The service area is approximately 175 acres and includes all of the unincorporated community of Chualar. 100 Consolidated Sewer This CSA was formed to provide a back-up funding Service (Backup Funding) mechanism in case the privately operated package INACTIVE treatment plants that provide sanitation service for five non-contiguous subdivisions were to seriously malfunction. The original areas in the CSA were Monterey Dunes Colony in northern Monterey County, Monterra Ranch inclusionary housing off Highway 68, The Bluffs subdivision (Reservation Rd, south of Salinas), Indian Springs Ranch (River Rd), and Oak Hills (near Castroville). The Highlands Inn, south of Carmel, was annexed to the CSA in 1990.
