ThereportconcludesthattheSantaCruzCountySanitationDistricthasadequatecapacitytoservethe areawithinthecurrentSphereofInfluence. Thedistrict’smainchallengeistorepairandreplaceold sewerlinesandpumpstations. Thedistricthasacapitalimprovementprogramtoaddressthese infrastructureneedsandiscurrentlyconstructingtheAptosTransmissionMainRelocationProject. Inthisstudy,theLAFCOstaffreviewedthedistrict’sboundariesandsphereofinfluenceinlightofthe plannedlandusesintheSantaCruzCountyandCityofCapitolaGeneralPlans. Particularattentionwas paidto1202parcelsaroundtheperimeterofthedistrict. Thestafffoundthatthecurrentsphereof influencelineislocatedinamannerconsistentwithLAFCO’spolicies,withtheexceptionof2parcels containingapproximately22acreslocatedoutsidetheCounty’sUrbanServicesLinebetweenresidential subdivisionsinSantaCruzGardensandNorthRodeoGulchRoad. Those22acresarecurrentlyinside theSantaCruzCountySanitationDistrictSphereofInfluence. Withsteeptopographyandruralzoningin the1 5acresperdwellingrange,thisareadoesnotneedtheurbanserviceofsanitarysewers.For LAFCO’spublichearingscheduledforJune1,2011,thestaffisrecommendingthatLAFCOmaintainthe district’scurrentsphereofinfluencewiththeexceptionthatthe22acresbetweenSantaCruzGardens andNorthRodeoGulchberemovedthesphere. Specifically,GovernmentCodeSection54625(a)statesthat: “Inordertocarryoutitspurposesandresponsibilitiesforplanningandshapingthe logicalandorderlydevelopmentandcoordinationoflocalgovernmentagenciesto advantageouslyprovideforthepresentandfutureneedsofthecountyandits communities,the[LAFCO]commissionshalldevelopanddeterminethesphereof influenceofeachlocalgovernmentalagencywiththecountyandenactpolicies designedtopromotethelogicalandorderlydevelopmentofareaswithinthesphere.” GovernmentCodesection56425(g)specifiesthat,beginningin2008,LAFCOshall,asnecessary,review andupdateeachsphereofinfluenceeveryfiveyears. Whenreviewingasphereofinfluence,LAFCO staffpreparesareport,suchasthisone,whichformsthebasisfortheCommission’sreviewatanoticed publichearing. ThepublichearingisscheduledforJune1,2011. ASphereofInfluenceisadoptedoramendedbyaLAFCOresolutionthatcontainsamapshowingthe adoptedsphere,includesasetofdeterminationsevaluatingtheserviceagency’scapabilitiesandthe plannedlanduses(GovernmentCodesection56425(e)),andmaycontainwrittenpoliciesspecifictothe agency’ssphere. Onceadopted,asphereofinfluenceisoneofthekeydocumentsthatcontrols thereorganizationofcityandspecialdistrictboundaries. DuringLAFCO’sreviewofaboundarychange application,GovernmentCodesection56375.5requiresthatanyboundarychangeapprovalLAFCO grantsmustbeconsistentwiththeadoptedspheresofinfluenceoftheaffectedagencies. 2.2.2LocalPolicies SantaCruzLAFCOhasadoptedasetoflocalpoliciesthatexplainthespherereviewprocessaswellas thesubstantivepoliciesthatLAFCOwilluseinreviewingallspheresofinfluence. TheSantaCruzLocal AgencyFormationCommissionSpheresofInfluencePoliciesandGuidelinescanbeaccessedat: http://santacruzlafco.org/pages/policies2009.html. Thelocalpoliciesandguidelinesbothrecognize theleadroleoftheCountyandthefourCitiesinpreparingGeneralPlans,aswellasLAFCO’sroleto encouragestaged,cost effectivedevelopmentpatternsandtheefficientprovisionofservices. ThemainthemeofthatfirstspherewasutilizingtheCounty’sUrban ServiceLineastheprimarytooltolocatethesphereline.Sanitarysewerisperhapstheclearestexample ofan“urbanservice.” Theadoptedsphereofinfluenceline,virtuallymatchingtheCounty’sUrban ServicesLine,includedtheseweredareasofthedistrictinLiveOak,Capitola,Soquel,andAptosand manydevelopedandundevelopedareasofLiveOak(SantaCruzGardens),Soquel,andAptosthatwere insidetheUrbanServicesLine,butnotyetannexedorsewered. The1983sphereexcludedaseriesof unseweredruralareasinthelowerSantaCruzMountainsaboveLiveOak,Soquel,andAptosthatwere outsidetheUrbanServicesLine,buthadannexedtotheSanitationDistrict,oritspredecessordistrict duringthe1950’s,1960’s,and1970’s. TheCityofCapitolaGeneralPlanningAreawastotallyincludedintheoriginal1983sphereline. 2.4RelationtoCountywideServiceReview GovernmentCode56430requiresLAFCOstoperiodicallyperformmunicipalservicereviews,alsoknown asservicereviews,inordertoprepareforsphereofinfluenceadoptionsorreviews. Thepurposeof servicereviewsistogeta“bigpicture”ofthepublicserviceneedsinacountyandtolookfor opportunitiesforimprovedserviceefficiencies. SantaCruzLAFCO’s“CountywideServiceReview”was adoptedbyResolutionNo.2007 9onDecember5,2007. ItcanbereviewedonLAFCO’swebsiteat: http://santacruzlafco.org/CSR.html. Thewastewaterchapterofthatservicereviewaddressedall sanitarysewersystemsinSantaCruzCounty,includingthesystemoftheSantaCruzCountySanitation District. Ingeneral,theCountywideServiceReviewfoundthattheSantaCruzCountySanitationDistrict wasanefficientproviderofsewerservices. Onespecificdeterminationofthatreportwasdirectedto thespherereview: “Initsnextsphereofinfluencereview,theDistrictandLAFCOshouldreviewthe northernboundaryofthedistrictinthefoothillsoftheSantaCruzMountainstoassure thatthesphereisconsistentwiththecurrentserviceareaandtheCounty’sUrbanServices Line. Followingthatspherereview,theDistrictandLAFCOmaythenconsiderwhetherto pursueareorganizationthatannexesanddetachespropertiestobringtheDistrict’s northernboundaryintothemaximumconformitywiththeCounty’sUrbanServicesLine.” 3.0 District Operations 3.1DistrictHistory TheSantaCruzCountySanitationDistrictwasformedin1973bytheconsolidationofthreesanitations districts:EastCliff,Capitola,andAptos. Atthattimeeachdistricthadaprimarytreatmentplantand oceanoutfallintoMontereyBay. ThedischargesdidnotmeeteithertheFederalorStatecleanwater standards. Duringthe1970’sthedistrictparticipatedinregionalsewerstudiesandultimatelyactedto abandonitstreatmentplantsandoutfall,buildatransmissionlineintotheCityofSantaCruz,and Page5of32 contractwiththecitytotreatanddisposeofthedistrict’ssewage. Thecitybuiltanewoutfallin1989 andaddedsecondarytreatmentin1998. 3.2ServicesProvided TheSantaCruzCountySanitationDistrictdirectlyprovidessanitarysewercollectionandtransmissionto aregionalsewagetreatmentplantoperatedbytheCityofSantaCruz. TheSantaCruzCountySanitation DistrictcontractswiththeCityofSantaCruztotreatthedistrict’ssewageattheCity’sTreatmentPlant adjacenttoNearyLagoonandtodisposeofthetreatedeffluentintheoceanoffWestCliffDrive. 3.3ServiceArea TheSantaCruzCountySanitationDistrictprovidessanitarysewerservicesto31,674connectionsinLive Oak,Soquel,Capitola,andAptos. Theserviceareapopulationisapproximately83,000.The district’s boundariesareMontereyBayonthesouth,AranaGulch(CityofSantaCruz)onthewest,ruralareas eastofAptosHighSchoolandAptosSeascapeontheeast,andtheurban/ruraltransitionatthebaseof theSantaCruzMountainsonthenorth. Thedistrict’sboundaries,includingtheunseweredareasinthemountains,contain13.2squaremiles. Thedistrict’sboundariesandsphereofinfluenceareshownonpage4andmaybeaccessedviathe Internet. Thedistrictoperates34sanitarysewerpumpstations. ThemainpumpstationalongthetransmissionmainislocatedattheD.A.PorathWastewaterFacilityat 2750LodeStreetoff27thAvenueinLiveOak. Thatfacilitypretreatssewagefromtheentiredistrict beforeitispumpedtotheCityofSantaCruzfortreatment. Thepumpstationsarelistedbelow. Page6of32 ThedistrictusesaSupervisoryControlandDataAcquisition(SCADA)systemtoremotelymonitorits pumpingstations. 3.4.2TreatmentContract TheSantaCruzCountySanitationDistrictpretreatsandtransmitsallsewagetotheCityofSantaCruzfor treatmentanddisposal.TheDistricthastreatmentcapacityrightsfor8milliongallonsoftreatmentper dayoutoftheplant’sdryweathertreatmentcapacityof17milliongallonsperday. Thedistrict’scontractwiththeCityrequiresthedistricttopayfor8/17(47%)fortreatment modifications.Operationalandmaintenancecostsaresplitbaseduponaformulathatincludesflow, biologicaloxygendemand,andsuspendedsolids. AsshownonthefollowingchartfromtheCity’s2009WastewaterTreatmentReport,thedistrictis utilizingapproximately4milliongallonsperdayoftreatment,orhalfofitsdryweathercapacity. The Cityreportednoincidenceoftreatmentplantperformancefailurein2009. UndertheNationalPollutantDischargeEliminationSystem(NPDES)permit,themaximumpeakwet weatherflowfortheplantis81milliongallonsperday. Thefinancialhighlightsofthatauditfollow. TheassetsoftheDistrictexceededliabilitiesatthecloseofthe2009/2010fiscalyearby $109,943,251(netassets). Ofthisamount,$24,267,407(unrestrictednetassets)maybeusedtomeet ongoingobligationstocitizensandcreditors;$1,524,139isrestrictedforspecificpurpose(restrictedfor debtservice);and$84,151,705isinvestedincapitalassets,netofrelateddebt. TheDistrict’stotalnetassetsincreasedby$4,579,965. Thisincreaseisprimarilyduetoan increaseof$870,818inrevenuesfromcustomers,and$1,868,296receivedbytheDistrictpursuantto theAmericanRecoveryandReinvestmentActof2009. TheDistrict’stotallong termdebtdecreasedby $2,103,429incomparisonwiththeprioryear. Thedecreaseresultedprimarilyfromscheduledprincipal retirementsofbondsandloanspayable.
