Below General (the OIG) maintains an Intake Processing are three complaints for which our Intake staff Unit, which receives complaints from the incarcerated conducted a review or inquiry and have closed as population and the public, in communication of October 2023. Incident Date OIG Case Number November 19, 2022 23-0049306-PI Case Type Complaint Summary Employee Misconduct On February 2, 2023, the OIG received a mail complaint from an incarcerated Rules Violation Report person (complainant) that alleged on November 19, 2022, he was issued a rules violation report and falsely charged with battery on an inmate with a weapon for attacking an incarcerated person. Specifically, the complainant alleged that two Mission other incarcerated persons entered the cell and stabbed another incarcerated Division of Adult person. However, on December 28, 2022, the complainant was found guilty of Institutions: High this alleged battery. Security OIG Actions The OIG obtained and reviewed a video recording and body-worn camera footage of the alleged incident. Since the video recording identified other incarcerated persons involved in the alleged battery and concern whether the control booth officer appropriately opened the cell door, the OIG requested the warden conduct an inquiry into potential staff misconduct. The OIG also identified a due process violation regarding the rules violation report that the prison had previously issued to the complainant and recommended the warden conduct further inquiry. Disposition On April 20, 2023, the warden submitted a confidential request for an Office of Internal Affairs’ investigation, and an administrative investigation was opened regarding the potential staff misconduct. Three correctional officers, including the control booth officer, were alleged to have failed to observe and perform within the scope of their training. On May 10, 2023, the Office of Internal Affairs opened an investigation, and the OIG’s Discipline Monitoring Unit selected the investigation for monitoring. Furthermore, based on the information identified during the department’s inquiry, the rules violation report was reissued by the prison and a new hearing held. On April 26, 2023, the complainant was found not guilty for the alleged battery of another incarcerated person. The anonymous source also alleged the correctional sergeant held a correctional officer visit with the correctional Mission sergeant privately in the space, and prison management were aware of this Division of Adult living situation. Institutions: General Population Males OIG Actions The OIG obtained and reviewed confidential records that confirmed the correctional sergeant and correctional officer were currently employed at the prison identified in the complaint. On March 2, 2023, the OIG requested that the Office of Internal Affairs open an investigation into this allegation of staff misconduct. Disposition On May 24, 2023, an administrative investigation was opened by the Office of Internal Affairs. It was alleged that the correctional sergeant temporarily resided and slept overnight in the investigative services unit between March 2, 2023, and March 30, 2023. In addition, both the correctional sergeant and the correctional officer allegedly misused State equipment between February 17, 2023, and March 7, 2023. The OIG’s Discipline Monitoring Unit is monitoring the investigation. The parolee stated that during his incarceration, on Mission April 22, 2022, the Office of Grievances had granted his property appeal to Division of Adult receive monetary compensation. However, the parolee was never compensated Institutions: High and was requesting the OIG’s assistance. Security OIG Actions The OIG reviewed departmental records and located documentation supporting the parolee’s claim. The OIG contacted the Office of Grievances regarding the delayed payment and processing status of the parolee’s reimbursement. The Office of Grievances coordinated processing of the payment with the prison’s trust office, the Division of Adult Parole Operations, the Office of Appeals, the Office of Legal Affairs, and the Special Processing Unit. Disposition On March 22, 2023, the department notified the OIG that the parolee’s payment request was approved, and the State Controller’s Office was issuing a payment to the parolee for compensation of lost and damaged property.
