SUMMARY At the September 14, 2004 hearing of the Voting Systems and Procedures Panel (VSPP) the Chair requested a status update report on items heard at the September 9th and 14th hearings. Items falling under this update were Election Systems and Software Model 100, 550 and 650 and Unity, Diebold Election Systems AccuVote-OS and VCProgrammer, Hart Intercivic eSlate Voting System, Sequoia Voting Systems AVC Edge and WinEDS. In addition, there are updates on several items scheduled for the October 5 hearing date. Specifically, there are updates on the Datavote Ballot/Card Readers and Election Systems and Software Optech Eagle, Optech IV-C and iVotronic. II. ITEM 1: ELECTION SYSTEMS AND SOFTWARE MODEL 100, 550 AND 650 AND UNITY At the September 9th hearing of the VSPP the panel recommended certification of the Model 100, Model 550 and Model 650, along with the Unity Election Management Software with several conditions. Two of these conditions were met prior to the issuance of a certification: 1. Federal qualification evidenced by NASED # N-1-02-21-21-002 was received. 2. Copies of all required federal Independent Testing Authority (ITA) reports were received. On September 17, 2004 a certification was issued that included most of the remaining recommended conditions for certification from the VSPP. The certification did not include the recommendation that the certification be limited to the November 2004 general election. Subsequent to the certification, the vendor completed the requirement that updated procedures be submitted to correct typographical errors. Those updated procedures have been posted on the Secretary of State’s website. No further action is currently required to meet the remaining conditions for certification. III. ITEM 3A: DIEBOLD ELECTION SYSTEMS ACCUVOTE-OS At the September 14th hearing of the VSPP the panel recommended certification of the AccuVote-OS with several conditions. ________________________________________________________________________________________________________ Status Update on Agenda Items 1, 3, 4, 5, 7, 8 and 10 September 29, 2004 Page 3 of 6 Two of these conditions were met prior to the issuance of a certification: 1. Federal qualification evidenced by NASED # N-1-06-12-12-004 was received. 2. Copies of all required federal Independent Testing Authority (ITA) reports were received. On September 28, 2004 a certification was issued that included the remaining recommended conditions for certification from the VSPP. No further action is currently required to meet the remaining conditions for certification. IV. ITEM 3B: DIEBOLD ELECTION SYSTEMS VCPROGRAMMER At the September 14th hearing of the VSPP the panel recommended certification of VCProgrammer with several conditions. Two of these conditions were met prior to the issuance of a certification: 1. Federal qualification evidenced by NASED # N-1-06-12-12-004 was received. 2. Copies of all required federal Independent Testing Authority (ITA) reports were received. 3. Submission of updated procedures to strengthen security requirements relating to the use of the program. Those updated procedures have been posted on the Secretary of State’s website. Another condition for certification was that any jurisdiction using VCProgrammer submit and receive approval for a security plan for the use of the program. Plans have been received for Alameda, Los Angeles and Plumas. These plans are currently under staff review. Certification has not yet been issued for this item. V. ITEM 4: HART INTERCIVIC ESLATE VOTING SYSTEM At the September 14th hearing of the VSPP the panel recommended certification of the eSlate Voting System with several conditions. On September 17, 2004 a certification was issued that included the recommended conditions for certification from the VSPP. ________________________________________________________________________________________________________ Status Update on Agenda Items 1, 3, 4, 5, 7, 8 and 10 September 29, 2004 Page 4 of 6 Subsequent to the certification, the vendor completed the requirement that updated procedures be submitted to require the posting of the tally tape at the polling place. Those updated procedures have been posted on the Secretary of State’s website. In addition, on September 21st, Secretary of State staff successfully testing the Kodak i830 and Fujitsu 4099 optical scanners, meeting that condition for certification. No further action is currently required to meet the remaining conditions for certification. VI. ITEM 5: SEQUOIA VOTING SYSTEMS AVC EDGE AND WINEDS At the September 14th hearing of the VSPP the panel recommended certification of the AVC Edge and WinEDS (along with the previously certified Optech 400C) with several conditions. Two of these conditions were met prior to the issuance of a certification: 1. Federal qualification evidenced by NASED # N-1-07-12-11-005 was received. 2. Copies of all required federal Independent Testing Authority (ITA) reports were received. On September 28, 2004 a certification was issued that included the recommended conditions for certification from the VSPP. No further action is currently required to meet the remaining conditions for certification. VII. ITEM 7: AVANTE OPTICAL VOTE-TRAKKER At the September 9th hearing of the VSPP, the Chair request that staff contact Avante about postponing its application until after November as it was not needed for the upcoming election. After contacting the vendor, Avante also indicated it desired to delay the hearing. Therefore, staff recommends continuing this item forward until the first hearing of the VSPP following the November 2, 2004 General Election. VIII. ITEM 9: DATAVOTE BALLOT/CARD READERS ________________________________________________________________________________________________________ Status Update on Agenda Items 1, 3, 4, 5, 7, 8 and 10 September 29, 2004 Page 5 of 6 At the time of the issuance of the notice for the October 5 VSPP hearing, Secretary of State staff was unable to verify the certification of the Datavote ballot/card readers used in two counties: Alpine and Yuba. On September 22 Secretary of State staff inspected the ballot/card readers in those two counties. Using the additional information gathered during those inspections, staff was able to verify the certification of the ballot/card readers used in those counties. Therefore, there is no application pending before the panel on this item and no action is required. IX. ITEM 10: ELECTION SYSTEMS AND SOFTWARE OPTECH EAGLE, OPTECH IV-C AND IVOTRONIC Testing has not yet been completed for the Optech Eagle, Optech IV-C and/or iVotronic.
