It ta SECRETARY OF STATE CONDITIONAL APPROVAL OF KNOWiNK, LLC Poll Pad Version 3.0.1 ELECTRONIC POLL BOOK SYSTEM Whereas, pursuant to California Elections Code section 2550, an electronic poll book shall not be used unless it has been certified by the Secretary of State; and Whereas, an electronic poll book means an electronic list of registered voters that may be transported to the polling location; and Whereas, KNOWiNK, LLC, submitted an application for certification of the Poll Pad Version 3.0.1, which is comprised of Apple iPad Generation 5 (32 Gigabyte), Apple iPad Generation 6 (32 Gigabyte), Apple iPad Generation 6 (32 Gigabyte Cellular), Apple iPad Generation 6 (128 Gigabyte), Apple iPad Generation 7 (32 Gigabyte), Apple iPad Generation 7 (32 Gigabyte Cellular), Apple iPad Generation 8 (32 Gigabyte), Apple iPad Generation 9 (32 Gigabyte), Apple iPad Generation 9 (32 Gigabyte Cellular), Apple iPad Air 2 (32 Gigabyte), Star Micronics Printer Model TSP650II, Star Micronics Printer Model TSP700II, Brother Pocket Printer Model JET PJ-763MFi, iOS Version 15.4, iOS Version 15.4.1, Poll Pad Application Version 3.0.1, and ePulse Version 3.0.1, submitted on or about January 3, 2022; and Whereas, during a series of tests conducted by the Secretary of State's office, the electronic poll book system performed in a manner consistent with California law; and Whereas, the electronic poll book system was able to successfully and accurately execute all test cases, scenarios, and scripts developed by the Secretary of State's office. Therefore, I, Shirley N. Webber, Ph.D., Secretary of State for the State of California, find and determine, pursuant to Division 2 of the Elections Code, as follows: For the reasons set forth above, KNOWiNK, LLC's Poll Pad Version 3.0.1 electronic poll book system is hereby conditionally approved. Use of KNOWiNK, LLC's Poll Pad Version 3.0.1 electronic poll book system is subject to the following terms and conditions: 1. Jurisdictions are prohibited from installing any software applications or utilities on any component of the electronic poll book system that have not been identified by the vendor and approved by the Secretary of State. 2. No changes or modification of the electronic poll book system shall be made with respect to any component of the electronic poll book system, including the Use Procedures, until the Secretary of State has been notified in writing and has determined that the proposed change · or modification does not impair the accuracy or efficiency of the electronic poll book system sufficient to require a re-examination and approval. 3. The Secretary of State-reserves the right, with reasonable notice to the vendor and to the jurisdictions using the electronic poll book system, to modify the Use Procedures used with the electronic poll book system and to impose additional requirements with respect to the use of the system if the Secretary of State determines that such modifications or additions are necessary to enhance the accuracy, reliability or security of any of the electronic poll book system. Such modifications or additions shall be deemed to be incorporated herein as if set forth in full. 4. The Secretary of State reserves the right to monitor activities before, during and after the election at any precinct or registrar of voters' office and may, at his or her discretion, test electronic poll book equipment. 5. Prior to the sale or use of the system in California, KNOWiNK, LLC must provide all jurisdictions its Use Procedures, entitled "KNOWiNK Poll Pad 3.0.1 User Guide" which the Secretary of State hereby approves. Compliance with the Use Procedures by the vendor and jurisdictions is a condition of the approval of this electronic poll book system. Compliance with all requirements set forth in the Use Procedures is mandatory, whether or not a particular requirement is identified in this approval document. 6. KNOWiNK, LLC is required to provide training to any jurisdiction using the system on the use of the electronic poll book system. 7. Pursuant to California Code of Regulations section 20159, any person, corporation, or public agency owning or having an interest in the sale or acquisition of an electronic poll book or part of an electronic poll book may submit a written request for review of any proposed change or modification to the Secretary of State. Any change or modification must be examined for conformance by the Secretary of State. Changes or modifications include appropriate security and critical software patches, or equivalent, to protect against the exploitation and compromise of voter registration data. 8. Electronic poll book systems certified for use in California shall comply with all applicable state requirements, including, but not limited to, those electronic poll book system requirements as set forth in the California Elections Code and California Code of Regulations. Further, electronic poll book systems shall also comply with all state and federal technology guidelines, standards, regulations and requirements that derive authority from or are promulgated pursuant to and in furtherance of the California Elections Code or other applicable state or federal law when appropriate. 9. Jurisdictions utilizing an electronic poll book, in any election, shall create and have on file an emergency preparedness plan that outlines the processes and procedures to be followed by county officials and poll w·orkers in the event of a failure of one or more of the electronic poll books. A copy of that plan shall be submitted to the Secretary of State no later than seven (7) days prior to its use in that election. 10. KNOWiNK, LLC and/or jurisdictions shall notify the Secretary of State immediately if the chain of custody has been compromised or a breach, attempted breach, defect, failure or fault has been experienced with respect to any electronic poll book or electronic poll book system component. 11. Within thirty (30) days from the end of canvass of any election, all equipment shall be formatted by the jurisdiction so that no voter data is resident on the equipment unless needed for litigation or recount purposes. 12. Prior to the disposal or sale of any electronic poll book or portion thereof, all equipment shall be cleared with a minimum of a two-pass wipe so that no software, firmware or voter data remains on the equipment. At the time of disposal or sale, the equipment shall be returned solely to a non-functioning piece of hardware and the following documented for each: • Whether the machine is void of all software, firmware and voter data. • The hardware model name. • The hardware model number. • The hardware serial number. 13. Electronic poll book system manufacturers or their agents shall assume full responsibility for any representation they make that an electronic poll book system complies with all applicable state and federal requirements, including, but not limited to, those electronic poll book system requirements as set forth in the California Elections Code and California Code of Regulations. In the event such representation is determined to be false or misleading, electronic poll book system manufacturers or their agents shall be responsible for the cost of any upgrade, retrofit or replacement of any electronic poll book system or its components found to be necessary for certification or otherwise not in compliance. 14. Pursuant to California Code of Regulations Section 20150(a)(2), KNOWiNK, LLC and/or jurisdictions must configure the data imported into the electronic poll book system from the jurisdiction's election management system (EMS) to ensure the following voter registration data is not contained in the electronic poll book system: • California driver's license number. • California identification number. • Social Security Number or portion thereof. 15. KNOWiNK, LLC and/or jurisdictions using the electronic poll book system shall configure the electronic poll book device in "Guided Access/Single Application/KIOSK Mode" according to the vendor provided Use Procedures prior to deploying the device. Jurisdictions are prohibited from deploying the device in full access mode. 16. KNOWiNK, LLC and/or jurisdictions using the electronic poll book system shall perform a complete Logic & Accuracy (L&A) testing of the end-to-end Poll Pad system prior to deploying the devices. This is to include but is not limited to election logic, applicable integration, all Poll Pad devices, and all peripherals. 17. KNOWiNK, LLC and/or jurisdictions using the electronic poll book system shall perform testing of the designated connectivity solution at each voting location prior to deploying the devices to ensure adequate connection and capacity is present to support the intended function of the Poll Pad system. 18. The vendor shall establish a California County User Group and hold at least one annual meeting where all California users and Secretary of State staff are invited to attend and review the system. 19. The next version of Poll Pad, presented as full certification or administrative approval, shall remediate the findings set forth in the Secretary of State's Staff Report. If KNOWiNK, LLC is unable to apply the remediations within that time, KNOWiNK, LLC shall submit to the Secretary of State documentation outlining why the changes cannot be made, how the changes would impact the system's accuracy and efficiency, if at all, and KNOWiNK, LLC's plan for applying the remediations. 20. This approval serves as notice to KNOWiNK, LLC and/or jurisdictions using the Poll Pad electronic poll book system that the Secretary of State withdraws conditional approval of all previously approved versions of the KNOWiNK Poll Pad system effective May 31, 2022.
